Rural Energy for America Program (REAP) Improvement Act of 2021 This bill modifies and provides additional funding for the Rural Energy for America Program (REAP), with a particular focus on greenhouse gas reduction. Under the program, the Department of Agriculture (USDA) supports energy efficiency and renewable energy development for agricultural producers and rural small businesses. As part of the selection criteria for a grant or loan from the program, USDA must consider the potential of a project to reduce greenhouse gas emissions and provide other climate benefits. The bill also prohibits USDA from imposing restrictions on the quantity of energy that is generated under a grant or loan. Further, the bill expands the program by making agricultural producer cooperatives, electric cooperatives, and nongovernmental organizations eligible for financial assistance under the program. The bill also (1) increases from 25% to 50% the portion of a project's cost that may be covered by a grant, and (2) establishes a reserve fund to provide grants and other financial assistance related to underutilized renewable energy technologies. In addition, USDA must study dual-use energy systems (i.e., systems where both renewable energy and agricultural production occur on the same piece of land) and ensure that grant and loan recipients receive outreach, technical assistance, and education concerning such systems.
Averting Loss of Life and Injury by Expediting SIVs Act of 2021 or the Allies Act of 2021 This bill increases the number of special immigrant visas available to qualified Afghan nationals who worked for the U.S. government or the North Atlantic Treaty Organization (NATO) missions in Afghanistan. The bill also relaxes certain qualifications for such visas. Specifically, this bill makes available an additional 8,000 visas for principal aliens under this special visa program, to be available until all such visas have been issued. (The numerical limitations in this program apply only to the principal alien who applies for the visa, not to any accompanying spouse or child.) Under this bill, an alien may qualify based on a credible basis for concern about the possibility of an ongoing serious threat in Afghanistan due to their work with the U.S. government or a NATO mission, where currently the alien must have experienced such a threat. The bill also eliminates a requirement for each applicant to submit a credible sworn statement describing that threat. Furthermore, for an applicant qualifying for a visa by performing duties for U.S. military personnel stationed with a NATO mission, this bill eliminates a requirement that the duties performed qualify as sensitive and trusted duties. If an alien submits a visa application that included an accompanying spouse or child but the alien passes away before the application is granted, the surviving spouse or child shall remain eligible to receive a visa under that application. Currently, a surviving spouse or child retains eligibility only if the application was approved before the alien passed away.
Universal School Meals Program Act of 2021 This bill revises requirements under the food and nutrition programs of the Department of Agriculture, such as the school lunch and breakfast programs. For example, the bill permanently provides free meals to all school children regardless of income. The bill increases the reimbursement rate for school food authorities participating in the food and nutrition programs. The bill also prohibits school food authorities from (1) physically segregating or otherwise discriminating against any child participating in the free breakfast program, or (2) overtly identifying a child participating in the program with a special token or announcement. Additionally, the bill expands the summer food service program by making all children eligible for participation in the program. Further, the bill revises eligibility determinations for measuring poverty to include runaway or homeless youth, foster children, migratory children, and children participating in specified programs (e.g., Head Start).
New Opportunities for Value that Extend Lives Act of 2021 or the NOVEL Act of 2021 This bill establishes a process for expediting the assignment of Healthcare Common Procedure Coding System (HCPCS) codes to medical products that have been designated as a breakthrough product or regenerative advanced therapy by the Food and Drug Administration; it also establishes a process for determining coverage under Medicare of such breakthrough products that have been assigned HCPCS codes.
Safe Schools Improvement Act of 2021 This bill requires states to direct their local educational agencies (LEAs) to establish policies that prevent and prohibit bullying and harassment of elementary and secondary school students. In particular, these policies must prohibit bullying and harassment based on race, color, national origin, sex, sexual orientation, gender identity, disability, or religion. Further, LEAs must provide (1) students, parents, and educational professionals with annual notice of the conduct prohibited in their disciplinary policies; (2) students and parents with grievance procedures that target such conduct; and (3) the public with annual data on the incidence and frequency of that conduct at the school and LEA level. The Department of Education must conduct and report on an independent biennial evaluation of programs and policies to combat bullying and harassment in elementary and secondary schools. The National Center for Education Statistics must collect state data to determine the incidence and frequency of the conduct prohibited by LEA disciplinary policies.
Consumer Protection and Recovery Act This bill authorizes the Federal Trade Commission (FTC) to seek monetary relief in federal court from businesses that engage in unlawful commercial practices such as false advertising, consumer fraud, and anticompetitive conduct. Specifically, the FTC may seek restitution in these cases for losses, rescission or reformation of contracts, refund of money, return of property, or disgorgement of unjust enrichment. On April 22, 2021, the Supreme Court held in AMG Capital Management, LLC v. Federal Trade Commission that the Federal Trade Commission Act does not authorize the FTC to seek, or a court to award, such relief.

Health Enterprise Zones Act of 2021 This bill provides for the designation of Health Enterprise Zones in certain geographic areas with documented and measurable health disparities. This designation, which expires 10 fiscal years after the bill's enactment, confers eligibility for certain grants, student loan repayment programs, and tax credits for those working to reduce health disparities and improve health outcomes in these zones. Specifically, community-based nonprofits or local government agencies, in coalition with health care providers, social service organizations, and others, may apply to the Department of Health and Human Services (HHS) for the designation. The application must include a plan to reduce health disparities and achieve other outcomes. In implementing the program, HHS must consult with, among others, the Department of Housing and Urban Development. When approving applications, HHS shall consider factors including geographic diversity and the commitment of supporting funds from the private sector. HHS (1) may award grants to organizations or agencies that applied for the designation to support activities aligned with their plans, and (2) must carry out a student loan repayment program for health care providers who agree to provide services in a Health Enterprise Zone. In addition, the bill establishes tax credits for employers that hire, and individuals who work as, Health Enterprise Zone workers.
Fair, Affordable, Innovative, and Resilient Transition and Competition Act or the FAIR Transition and Competition Act This bill requires the Department of the Treasury, not later than July 1, 2023, and annually thereafter, to determine the domestic environmental cost incurred for industrial facilities producing steel, aluminum, cement, iron, or other products (sectors), and for the production of natural gas, petroleum, or coal (covered fuels) that are or may be used to emit greenhouse gases. By that same date, the Environmental Protection Agency must determine and publish the average greenhouse gas emissions of each sector to determine progress in reducing such emissions. The bill imposes a fee (border carbon adjustment) on importers of covered fuels and products. Treasury must provide to each state a resilient communities grant to provide job training and worker transition assistance, assist certain governmental entities and frontline communities, alleviate historical burdens imposed on communities of color and other vulnerable populations, and to assist small businesses disproportionately impacted by the border carbon adjustment fee.
Medium- and Heavy-Duty Electric Vehicle Infrastructure Act of 2021 This bill directs the Environmental Protection Agency to establish a rebate program that encourages the purchase and installation of electric vehicle charging equipment for medium-duty electric vehicles and heavy-duty electric vehicles.
Facilitating Innovative Nuclear Diagnostics Act of 2021 This bill establishes separate payment requirements for diagnostic radiopharmaceuticals under the Medicare prospective payment system for hospital outpatient department services. The bill's requirements apply to diagnostic radiopharmaceuticals that have an average daily cost of $500 or more in 2022 and as adjusted based on a specified fee schedule factor in each year thereafter.
Uyghur Forced Labor Prevention Act This bill imposes importation limits on goods produced using forced labor in China, especially the Xinjiang Uyghur Autonomous Region, and imposes sanctions related to such forced labor. The Department of Homeland Security shall report to Congress a strategy for preventing the importation of goods produced in China using forced labor. The strategy must contain certain information, including a list of entities working with the government in Xinjiang to move forced labor or Uyghurs, Kazakhs, Kyrgyz, or members of other persecuted groups out of Xinjiang. The U.S. Customs and Border Protection shall generally presume that goods produced by these entities and certain other entities, generally those sourcing material from Xinjiang or involved with Chinese government forced labor programs, are barred from importation into the United States. The bill also expands existing asset- and visa-blocking sanctions related to Xinjiang to cover foreign individuals and entities responsible for serious human rights abuses in connection with forced labor. The Department of State shall report to Congress a strategy to enhance international awareness of forced labor in Xinjiang and to address such forced labor.
