This resolution expresses the condolences of the Senate regarding the death of the Honorable Mike Enzi, former Senator for Wyoming.
Medical Device Nonvisual Accessibility Act of 2021 This bill requires certain medical devices with a digital interface to meet nonvisual accessibility standards established by the Food and Drug Administration (FDA). Specifically, the FDA must establish regulations to require a Class II or Class III medical device with a digital interface to provide a blind or low-vision user access to the same services and information, and generally the same ease of use, as provided to a user who is not low-vision or blind. (The FDA classifies medical devices in three classes. Class I devices are low-risk, Class II devices are moderate-risk, and Class III devices are high-risk.) A Class II or Class III medical device that does not meet the nonvisual accessibility standards established under this bill may not be sold.
Safe School Drinking Water Act This bill requires the Environmental Protection Agency to establish a program to award grants to assist local educational agencies in installing and maintaining filtration stations (e.g., drinking fountains) at schools and child care programs.
Domestic Workers Bill of Rights Act This bill provides rights and protections for domestic workers (e.g., housekeepers, nannies, caretakers, personal assistants, and chauffeurs), including pay and leave rights, and health and safety protections. Specifically, the bill repeals the exemption of domestic live-in employees from certain minimum wage and maximum hour requirements. Employers must provide written notice of termination and provide at least 30 days of lodging and two weeks of severance pay to terminated live-in employees. Live-in employees also must be provided with reasonable access to telephone and internet service during their employment. The bill requires employers to provide domestic workers with a written agreement covering wages, sick leave, benefits, and other matters. Further, domestic workers may request and be granted changes to work schedules due to personal events. The bill also provides domestic workers with certain privacy rights, extends to domestic workers protections against discrimination in employment, and increases the federal medical assistance percentage (FMAP) for certain Medicaid-funded medical services provided by domestic workers. The Department of Labor must (1) award grants for a domestic worker national hotline for reporting emergencies, training on hazards facing domestic workers, and workforce investment activities for domestic workers; and (2) establish a Domestic Worker Wage and Standards Board to investigate standards in the domestic workers industry. Labor must publish online a document that describes the rights and protections for domestic workers under this bill.
Protecting Renters from Evictions Act of 2021 This bill extends through December 31, 2021, the order issued by the Centers for Disease Control and Prevention titled Temporary Halt in Residential Evictions To Prevent the Further Spread of COVID–19 and published on September 4, 2020.
Judicial Understaffing Delays Getting Emergencies Solved Act or the JUDGES Act This bill requires the appointment of additional U.S. district court judges, converts certain temporary district court judgeships into permanent judgeships, and requires the Government Accountability Office to report on vacant or underused federal courthouses. Specifically, the bill requires the appointment of 39 district court judges on or after January 21, 2025, in specified judicial districts in Arizona, California, Colorado, Delaware, Florida, Georgia, Idaho, Indiana, Iowa, New Jersey, New Mexico, New York, and Texas. Further, 38 district court judges must be appointed on or after January 21, 2029, in specified judicial districts in Arizona, California, Colorado, Delaware, Florida, Georgia, Indiana, New Jersey, New York, and Texas. Additionally, the bill converts certain temporary district court judgeships to permanent judgeships in specified judicial districts in Alabama, Arizona, California, Florida, Kansas, Missouri, New Mexico, North Carolina, and Texas.
Congressional Whistleblower Protection Act of 2021 This bill creates certain administrative and judicial remedies for federal employees whose right to provide information to Congress is interfered with or denied. Under current law, federal employees have the right to petition or furnish information to Congress or to individual Members of Congress, and this right may not be interfered with or denied. The bill explicitly allows employees who are aggrieved by a violation of this right to seek administrative remedies that are currently available to whistleblowers who are fired or experience other forms of retaliation. The bill also establishes a private right of action for aggrieved employees, including the option of a jury trial, if an administrative remedy is not issued within 210 days of a complaint being made. The bill applies to employees and contractors of the executive, legislative, and judicial branches of government, including members of the intelligence community.
Choose Home Care Act of 2021 This bill provides for coverage of home-based extended care services under Medicare. Specifically, the bill provides for coverage of services that are furnished to Medicare beneficiaries in their homes by home health agencies, including nursing care, meals and nutritional support, home medical supplies, nonemergency medical transportation, and care coordination. Coverage includes 30 days of post-hospital care and other periods of extended illness, as determined by the Centers for Medicare & Medicaid Services (CMS). Home health agencies that provide such services may receive additional payments in accordance with a specified methodology. The CMS may make payments for covered services furnished before 2022 during any period in which there is a public health emergency.
Evaluating Disparities and Outcomes of Telehealth During the COVID-19 Emergency Act of 2021 or the EDOT Act of 2021 This bill requires the Centers for Medicare & Medicaid Services (CMS) to report on the effects of changes that were made during the public health emergency relating to COVID-19 with respect to the provision or availability of telehealth services under Medicare and Medicaid. Among other information, the report must include (1) a summary of all services utilized by beneficiaries during the emergency period, including the number of telehealth visits and in-person visits; (2) any changes in utilization compared to prior periods; and (3) demographic characteristics of beneficiaries who utilized telehealth services. The CMS must submit the required reports after the end of the emergency period, as specified.
Provider Relief Fund Deadline Extension Act This bill extends the period during which health care providers may use payments received from the Provider Relief Fund to cover a variety of costs related to COVID-19.
Supreme Court Ethics Act This bill establishes a new statutory requirement for the Judicial Conference of the United States to issue a judicial code of conduct for judges and justices of U.S. courts, including Justices of the Supreme Court. Currently, the Judicial Conference issues a code of conduct for judges of U.S. courts (but not for Justices of the Supreme Court).
Offshore Wind Jobs and Opportunity Act This bill authorizes the Department of Energy to award offshore wind career training grants to institutions of higher education or labor organizations to develop, offer, or improve educational or career training programs that provide skills necessary for employment in the offshore wind industry.
