San Diego Unified Port District: job order contracting: pilot program.

Removed amendment history lines (dates of prior Senate and Assembly amendments) and replaced with passage dates: Passed the Senate August 27, 2026 and Passed the Assembly August 26, 2026.

Replaced the introduction header (senator name and February 5, 2026 date) with standard enrolled bill formatting including Secretary of the Senate and Chief Clerk of the Assembly lines.

Added enrolled bill signature block language: 'This bill was received by the Governor this day of , 2026, at o'clock m.' and 'Approved , 2026' with a line for the Governor's signature.

Legislative counsel's digest header changed from 'SB 983, as amended, Weber Pierson' to 'SB 983, Weber Pierson' (removed 'as amended').

The definition of 'District' was expanded to explicitly include facilities at the Tenth Avenue Marine Terminal, National City Marine Terminal, B St. Cruise Ship Terminal, Broadway Cruise Ship Terminal, and any future cargo or cruise terminals.

The term 'Longshore and maritime operations' was renamed to 'District maritime and longshore operations,' and references throughout the bill were updated accordingly.

The definition of 'Repair, remodeling, or other repetitive work' was narrowed by removing 'construction' from the list of covered activities and adding the phrase 'according to unit prices.'

Memoranda of understanding were added alongside collective bargaining agreements as protected instruments that job order contracts must comply with, in three separate places in Section 20755.1(a)(2).

New construction was added as an exclusion from job order contracts in Section 20755.1(a)(4), meaning annual contracts may not be awarded for large-scale capital development projects or new construction exceeding the monetary limits.

The maintenance and repair scope in Section 20755(b)(1)(B) was expanded to include work 'to load or unload vessels at the district's facilities,' and subsection (C) added the word 'necessary' before 'to facilitate the movement of cargo.'

Project labor agreement compliance was expanded from applying only to 'a job order contractor' to also include 'subcontractors at every tier' in Section 20755.1(d)(5).

The small business and disabled veterans business enterprise preference threshold (jobs of $250,000 or less) was broadened from covering only 'repair or renovation work' to covering 'repair, remodeling, or other repetitive work' in Section 20755.1(d)(6).

Removed the amendment to Section 12928 of the Insurance Code, which dealt with the Insurance Commissioner's duty to certify criminal violations to district attorneys. This was described as a technical, nonsubstantive change and is no longer part of the bill.

The bill title and legislative digest were updated to remove all references to the Insurance Code and the Insurance Commissioner, narrowing the bill's scope to only the San Diego Unified Port District job order contracting pilot program.

Added Article 48.5 (Sections 20755-20755.7) to the Public Contract Code, creating a pilot program authorizing the San Diego Unified Port District to use job order contracting notwithstanding existing port district public contracting requirements.

Defined 'longshore and maritime operations' (loading/unloading cargo at specific terminals, maintenance of nondistrict-owned containers and equipment) and excluded those operations from job order contracting eligibility. Also defined 'repair, remodeling, or other repetitive work' as the eligible scope.

Set monetary caps: $5,000,000 maximum per single job order contract in the initial term, $1,000,000 maximum per single job order, and $10,000,000 maximum over two subsequent extension terms. Dollar amounts adjustable annually by California CPI.

Initial contract term limited to 12 months with up to two annual extensions. Report to Legislature required by January 1, 2035. Entire article repeals on January 1, 2037.

Required job order contracts to be competitively bid, comply with collective bargaining agreements, and be subject to a project labor agreement with the San Diego County Building and Construction Trades Council. Prevailing wage applies to all work regardless of thresholds in Labor Code Section 1771.5.

Allowed the district to award job orders of $250,000 or less directly to certified small business enterprises or disabled veterans business enterprises without competitive bidding among all qualified bidders.

Required independent cost estimates before issuing any job order to prevent fraud, waste, and abuse. Authorized termination, ineligibility for future contracts, or withdrawal of work authorization for violations including bid shopping.

The original Insurance Code Section 12928 amendment (removing 'Whenever,' changing 'he' to 'the,' removing 'such') is retained but renumbered from Section 1 to Section 2 due to the insertion of the new public contracting article.
