California Environmental Quality Act: environmental impacts: building height.
What changed between versions
The entire project-specific CEQA exemption for the Midway Rising Specific Plan in San Diego (former Section 21080.75) was deleted, along with all legislative findings and declarations justifying it. This exemption would have waived CEQA review for that development entirely if it met conditions including creating at least 4,250 residential units (2,000 affordable), sustainability requirements, and job creation.
All 15 legislative findings (subsections a through o) describing the Midway Rising project's housing, economic, sustainability, and fair-housing benefits were removed from the bill.
The general building-height provision was renumbered from Section 21081.5 to Section 21080.82 in the Public Resources Code, changing its placement within the statute but not its substantive content.
A placeholder for Section 21081.5 appears in the new version with no operative text (only the section number), which is likely a drafting artifact or error from the renumbering process.
