What changed between versions
Removed the rebuttable presumption that applied when an employee's photograph or likeness appeared incidentally (not essentially) in a publication prepared by or on behalf of the user. Previously, this created a presumption that the failure to obtain the employee's consent was not a 'knowing' use, making it harder for employees to win privacy claims against their employers.
Added new subdivision (f) stating that for purposes of Section 3344, a 'voice or likeness' includes a digital replica as defined in Section 3344.1. This extends the bill's privacy protections to cover AI-generated or other digitally created replicas of a person's voice or likeness.
Removed all legislative counsel line-number markup (line X indicators) that showed prior amendment changes, and reformatted the document into final enrolled bill format with Senate and Assembly passage dates (September 10-11, 2025), Secretary/Clerk signature lines, and Governor approval block.
