Elderly Parole Program.

Added new Section 1 amending Penal Code Section 3055 to establish the Elderly Parole Program with a minimum age of 60 (raised from 50) and a minimum of 25 years of continuous incarceration (raised from 20). The program applies to inmates serving determinate or indeterminate sentences.

Added exclusions from the Elderly Parole Program for cases sentenced under Three Strikes law, life without parole, death penalty, and first-degree murder of a peace officer killed in the line of duty.

Narrowed the list of materials the Board of Parole Hearings must consider at parole suitability hearings. The Senate version required consideration of a broad range of items including written statements, photographs of inmates and victims, police reports, investigative reports, autopsy reports, victim and witness statements, court transcripts, court documents, printed media articles, social media postings, online petitions, business records, and any other relevant documents or photographs. The Assembly version limits this to crime scene photographs, autopsy photographs, and photographs of weapons used in the crime.
