Mental health: involuntary commitment.

Added clarification at the end of subdivision (a)(4) stating that a passive monitoring and review process that responds to and investigates complaints and grievances, to the extent deemed appropriate by the county, satisfies the monitoring requirement. This means counties do not need to proactively audit or inspect designated professionals.

Removed the former subdivision (g) which stated that the section does not require a county behavioral health director to designate each individual who meets the requirements in subdivision (a). The remaining 'nothing in this section shall be construed to limit' language still preserves county discretion, making the removed provision largely redundant.

Fixed a grammatical error in subdivision (a), changing 'develop procedures for establish and implement procedures governing' to 'establish and implement procedures governing.'

Section 5121(a) was changed from requiring counties to 'develop procedures for the county's designation and training of professionals' to requiring them to 'develop procedures for establish and implement procedures governing the county's designation and training of professionals.' This broadens the obligation beyond just creating procedures to also implementing them, though the phrasing appears to contain a drafting error.

A new subdivision (g) was added stating that nothing in the section limits a county's authority to establish its own criteria and procedures governing designation, including those described in paragraphs (1) through (4) of subdivision (a), provided those criteria and procedures are consistent with the section. This is a savings clause preserving local autonomy.

All homelessness-related provisions were removed: the amendment to Government Code Section 65584.04 (housing element allocation methodology), the new Article 3 in the Health and Safety Code establishing HHAP round 7 with housing now action plans and five-year inventory expansion targets, and the amendment to Revenue and Taxation Code Section 214 (property tax welfare exemption for interim housing).

In the remaining mental health provision (Welfare and Institutions Code Section 5121), the language was changed from permissive to mandatory: county behavioral health directors now 'shall' develop procedures for designating and training professionals under Section 5150, rather than being permitted ('may') to do so. The same change applies to the requirement that these procedures include specified elements.

Assembly Member Dixon was added as a coauthor of the bill.

County behavioral health directors are now required (changed from 'may' to 'shall') to develop procedures for designating and training professionals who perform functions under Section 5150 (72-hour involuntary holds). This creates a state-mandated local program with associated reimbursement obligations.

If a county behavioral health director denies or revokes an individual's designation, the director must provide written notice to both the person who made the designation request and the individual whose designation was denied or revoked, describing the reasons.

Emergency physicians must now be included as one of the practice disciplines eligible for county designation to perform involuntary hold functions. An 'emergency physician' is defined as a physician providing medical screening and treatment in the emergency department of a general acute care hospital.

Designated members of mobile crisis teams and designated professionals are explicitly protected from being prohibited from transporting a person taken into custody under Section 5150.

Sacramento County-specific provision: if the county behavioral health director develops procedures, the director must designate City of Sacramento employees who are also mobile crisis team members or professional persons, provided the city submits a written request, the individuals meet policy requirements, and they complete any required training.

The amendment to Government Code Section 65583 was removed. This provision had required local governments not receiving HHAP funding to include the most up-to-date data on the number of unhoused individuals and a description of key actions to reduce that number in their housing element assessments.

Provisions relating to the Interagency Council on Homelessness conducting or contracting for a statewide homelessness assessment were removed from the bill.

Provisions requiring the Department of Housing and Community Development to complete a 10-year assessment and financing plan addressing unsheltered and chronic homelessness, with a report due to the Legislature by December 31, 2027, were removed from the bill.

The bill is now named the Ending Street Homelessness Act (new Section 1).

The bill now also amends Section 65584.04 of the Government Code and Section 214 of the Revenue and Taxation Code, and both adds and repeals Article 3 of the Health and Safety Code (Section 50245 et seq.).

The extensive emergency shelter zoning requirements previously added to Section 65583 (identifying zoning designations where shelters are permitted use, objective standards for shelters, site capacity at 200 square feet per person, and related provisions) have been removed from the housing element.

New Section 65584.04 requires councils of governments to develop a proposed methodology for allocating regional housing needs, including surveying member jurisdictions, considering factors like jobs-housing relationships, land availability, transportation, agricultural preservation, and climate change impacts, and holding public hearings.

HHAP Round 7 eligibility now requires a 'housing now action plan' (replacing the old 'regionally coordinated homeless action plan'), an enacted encampment resolution ordinance, and a signed memorandum of understanding committing to participation and compliance. The old requirement for counties to contribute 50% of city-operated shelter costs is removed.

The requirement that the Behavioral Health Services Act integrated plan include a section on HHAP Round 7 programs and services has been removed.

Until January 1, 2032, newly constructed interim housing (noncongregate accommodations contracted to operate at least through the current allocation cycle) must be counted as meeting the needs of acutely low income households in the regional allocation methodology.

The bill requires the department to determine each region's 5-year housing inventory expansion target and develop an annual schedule from fiscal year 2026-27 through 2030-31, with regions required to expand homeless habitation capacity until the target is met.

A new property tax welfare exemption (Revenue and Taxation Code Section 214) applies to property owned and operated by qualifying nonprofit entities and used exclusively for interim housing, for lien dates on or after January 1, 2026 and before January 1, 2032. No state reimbursement is provided for lost local tax revenues.

The vote requirement was changed from majority to two-thirds. Multiple new provisions are set to expire or repeal on January 1, 2032.

New definitions added: 'interim housing' (rooms occupied by homeless individuals providing separate sleeping quarters on a nonpermanent basis) and 'functional zero unsheltered homelessness' (sufficient housing options to accommodate at least 60 percent of the population, text truncated).

Requires HUD to complete or contract for an assessment and financing plan to address unsheltered and chronic homelessness over a 10-year period, in coordination with local jurisdictions. The plan must include the number of people experiencing unsheltered homelessness and projections of how many more will become unsheltered over the next 10 years based on recent data.

The department or its contractor must consult with individuals with lived experience of homelessness, representatives of cities and counties, and specified working groups when completing the assessment. This consultation requirement is what triggers the state-mandated local program designation.

HUD must report to the Legislature on the assessment and financing plan by December 31, 2027.

The Welfare and Institutions Code section being amended changes from Section 5963.02 to Section 8257.1, shifting which behavioral health provision is affected by the bill.

State-mandated local program designation changes from 'no' to 'yes,' formally acknowledging that the new consultation requirements impose costs or duties on local governments that may require state reimbursement.

Fiscal committee vote changes from 'no' to 'yes,' meaning the bill now requires approval by the Legislative Fiscal Committee before passage.

The housing element data requirement for non-HHAP jurisdictions is reworded from 'specified data regarding the population of individuals who are unhoused' to 'the most up-to-date data on the number of individuals who are unhoused,' and the action goal changes from 'reduce individuals who are unhoused' to 'reduce the number of individuals who are unhoused.'

The bill now amends three separate statutes (Government Code 65583, a new Health and Safety Code article for HHAP Round 7, and Welfare and Institutions Code 5963.02) instead of containing only a single intent declaration.

The bill now includes findings that it addresses a matter of statewide concern applying to all cities including charter cities, and is flagged as containing a state-mandated local program with fiscal committee review (both changed from 'no' in the introduced version).

Local governments must identify zoning designations where emergency shelters (including navigation centers, bridge housing, and respite care) are allowed as a permitted use without discretionary permits, with limits on what objective standards may be applied (e.g., no more than 300 feet separation between shelters).

Local governments not receiving HHAP funding must include in their housing element: an itemized list of resources for unhoused individuals, detailed data on the unhoused population disaggregated by age and race/ethnicity (including number unhoused, average length of time, transitions to permanent housing, re-entry rates, first-time homelessness, and exits from jails/prisons/hospitals), and a description of key actions to reduce homelessness.

The Behavioral Health Services Act integrated plan must now include a section on programs and services relating to HHAP Round 7.

Allows multijurisdictional agreements (up to two adjacent communities) to satisfy emergency shelter zoning requirements by developing at least one year-round emergency shelter within two years of the planning period, with capacity allocated among participating jurisdictions.

Establishes Round 7 of the HHAP program requiring jurisdictions to apply as part of a region and sign a regionally coordinated homeless action plan. Counties must contribute 50% of expected costs for city-operated shelters, with a mechanism for counties to petition the department to reduce that percentage if financially infeasible.

By the end of the 2025-26 fiscal year, HHAP grantees must submit an update on their regionally coordinated homeless action plan activities, cities must submit actual operating costs of city-operated shelters, and counties must reimburse cities for any excess contributions. The department may withhold 50% of funds until the update is approved.
