Adult community care facilities: email address of record.

The bill's scope expanded from amending only Section 1509.6 (adult community care facilities) to amending four sections: 1509.56, 1509.6, 1568.023, and 1569.15, extending the email notification deadline change to residential care facilities and residential care facilities for the elderly.

The deadline for notifying the department of a change to an email address of record was extended from 10 business days to 12 business days across all four amended sections.

Section 1569.15 now requires applicants for residential care facilities for the elderly to disclose detailed information including: ownership structure (beneficial owners with 10 percent or more interest), management companies, real property owners, prior disciplinary actions within 10 years, bankruptcy filings within 5 years, financial resources, and evidence of completing a prelicensure education program.

New ongoing reporting obligations require licensees to report changes within 30 calendar days (or six months for certain ownership information), with out-of-state facility information updatable annually. The department must cross-check applicant information with the State Department of Public Health.

New enforcement provisions allow the department to deny an application or revoke a license if the applicant knowingly withheld material information or failed to disclose administrative disciplinary actions. A civil penalty of $1,000 may be assessed for a material violation of Section 1569.15.

An exemption was added for silent investors in publicly traded companies or investment funds who do not have influence or control over operations, meaning their names need not be disclosed on the application.
