Federal immigration enforcement: report.

The bill was moved from adding Section 7284.9 to the Government Code to adding Section 11012 to the Penal Code, shifting the legal framework from administrative law to criminal/penal code.

A new temporal limitation requires the annual report to cover only immigration enforcement incidents occurring on or after September 1, 2025. The prior version had no such date restriction.

The term 'designated safe location' was replaced with 'designated location.' The definition was narrowed in some areas and expanded in others: 'educational institutions' became 'schoolsites' (defined in Education Code 234.7); 'courthouses' became 'state courthouses'; 'public transportation property' became 'public transportation access points, including but not limited to bus stops and transit stations'; and 'shelters' was expanded to explicitly include homeless shelters.

A new privacy prohibition was added: the report must not include the physical address of any designated location. The prior version only prohibited personally identifiable information about individuals stopped, detained, or arrested.

New language requires the Attorney General to adhere to privacy laws and procedures when reporting followup or resolution status, to ensure the integrity of ongoing investigations.

The definition of 'designated safe location' was narrowed by removing 'areas where the public may be exercising their rights protected under the First Amendment to the United States Constitution.' The term now covers only educational institutions, health care provider entities, shelters, polling places, courthouses, public transportation property, and state and local government property.

A new subsection (g) prohibits the Attorney General's annual report from including personally identifiable information regarding any individual stopped, detained, or arrested by a person conducting an immigration enforcement incident or activity.

A new exclusion was added clarifying that 'legal action' for reporting purposes does not include a legal action or administrative proceeding against an individual for enforcement of federal immigration law, nor a prosecution of an individual under federal criminal law.

The reporting mechanism was clarified to specify that incidents may be reported 'either onsite or by the designated safe location or a person who witnessed the activity to the Attorney General,' making the witness reporting pathway more explicit.

Subsection (3)(A) was revised to specify that legal actions counted in the report are those 'regarding the incident or activity's legality' and to change the location detail from 'counties involved' to 'the county or court in which the legal action took place.'

The definition of 'designated safe location' (now singular) was changed from 'health care providers, provider entities, as defined in Section 24252 of the Health and Safety Code' to 'health care provider entities, as defined in Section 24252 of the Health and Safety Code,' removing standalone 'health care providers' as a separate category and relying only on the statutory definition of 'provider entities.'

The term 'designated safe locations' was changed to singular 'designated safe location' throughout the bill, including in the definition section, reporting requirements, and enforcement provisions.

Senators Perez and Weber Pierson were added as coauthors of the bill.

In subsection (a)(3), the phrase 'the counties involved in the legal action' was changed to 'the counties in which the legal action took place,' a minor clarification of where legal actions are counted.

Subsection (d) was clarified from 'compliance with other state law, laws related to immigration enforcement and may take enforcement action, action to enforce those laws' to 'compliance with other state laws related to immigration enforcement and may take enforcement action to enforce those laws,' removing redundant phrasing.

Changed 'immigration incidents and activities' to 'immigration enforcement incidents and activities' throughout, narrowing what must be reported to only those involving enforcement actions rather than any immigration-related incident.

Added 'provider entities, as defined in Section 24252 of the Health and Safety Code' to the list of designated safe locations, expanding which facilities are protected under the reporting requirement.

Added a new definition of 'immigration enforcement' as an effort to investigate, enforce, or assist in the investigation or enforcement of a federal civil immigration law or a federal criminal immigration law that penalizes a person's presence in, entry or reentry to, or employment in the United States.

Broadened the Attorney General's enforcement authority in subsection (d) from considering compliance with 'other state law' to specifically including 'laws related to immigration enforcement,' giving the AG explicit authority to enforce immigration-related state laws at designated safe locations.
