Social media platforms: child influencers.

The entire Business and Professions Code chapter (Chapter 22.1.3, Sections 22583-22583.2) was removed from the bill. This chapter contained duplicate definitions and requirements that mirrored the Family Code provisions now retained in the enrolled version.

The bill title was shortened to reference only the Family Code addition, removing the reference to adding Chapter 22.1.3 to the Business and Professions Code.

Assembly Member Bauer-Kahan was removed as co-author in the enrolled version, which is standard when a bill passes both chambers and becomes enrolled.

A new Part 2.6 (Sections 6665-6667) was added to Division 11 of the Family Code containing definitions for child influencer, paid content, social media platform, and vlogger; a requirement that social media platforms provide a mechanism for child influencers to request deletion or editing of paid content; and a civil action provision with statutory damages of $3,000 per day. This mirrors the existing Business and Professions Code provisions.

The bill now applies under two separate code sections (Family Code and Business and Professions Code) rather than just one, expanding the legal framework available to child influencers seeking relief against vloggers who fail to delete or edit paid content featuring them as minors.

The digest adds a reference to existing law requiring a vlogger to compensate a minor under 18 if engaged in vlogging work, providing additional legal context for the Family Code placement.

Minor wording change in the injunctive relief standard: removed the phrase 'In a civil action brought pursuant to this section' before 'considering whether to grant injunctive relief,' simplifying the language without changing the substantive test.

The definition of 'vlogger' now requires that content featuring the child influencer must constitute at least 30 percent of the person's total content shared on social media platforms. This significantly narrows who is covered by the law, excluding parents or family members who only occasionally feature their child in paid content.

Child influencers can now request deletion or editing directly from the vlogger, not only through the platform's mechanism. The platform notification process (3 business days) now applies only as a fallback when the platform's mechanism does not enable direct submission to the vlogger.

Section 22583.2(b) was narrowed so that courts are required to consider factors like emotional harm, harassment risk, loss of control of personal information, and harm to future opportunities only when deciding whether to grant injunctive relief, rather than for all civil actions under the chapter.

Assembly Member Bauer-Kahan was added as a coauthor of the bill.
