Judicial Council: eviction data reporting.

All major deadlines were extended by roughly five years: the Judicial Council assessment deadline moved from July 1, 2027 to July 1, 2032; early reporting began January 1, 2028 instead of January 1, 2029 (now 2033); and full compliance plus public posting moved from January 1, 2029 to January 1, 2034.

The frequency of public data posting changed from every four months (in the June version) to annually (in the August version).

A new Section 68653 was added making implementation of the entire chapter contingent upon appropriation of sufficient funding by the Legislature in the annual Budget Act or other statute. This means the bill's requirements will not take effect unless the Legislature actually allocates money for it.

The reporting mechanism was restructured. The June version required courts to directly report monthly data to the Judicial Council. The August version instead requires the Judicial Council to first assess each county's readiness, then phase in quarterly reporting through JBSIS (described as an automated data collection system), with early adopters starting first and all counties following by 2034.

The specific data points changed. The June version tracked cases that went to trial (bench vs. jury) and dismissals before trial at plaintiff's request only. The August version tracks cases subject to default, stipulated, or other types of pretrial AND posttrial judgments, and includes dismissals by court order in addition to plaintiff's request.

A small-county exemption was added: if a county averaged 100 or fewer unlawful detainer filings over the previous five fiscal years, its data will only be published at the county level rather than broken down by ZIP Code, likely to protect tenant privacy in smaller jurisdictions.

The bill analysis section's discussion of the Sargent Shriver Civil Counsel Act and its grant programs for low-income legal representation was removed, narrowing the stated context of the bill.

Removed a new Chapter 8 (Section 156) of the Code of Civil Procedure that would have required the Judicial Council to collect data on the number of eviction proceedings initiated, the number of tenants represented by counsel, and the number of landlords represented by counsel, make it publicly available online yearly, and report annually to the Legislature starting July 1, 2027.

Added a phased implementation schedule: by July 1, 2027 the Judicial Council must assess each county's readiness; beginning January 1, 2028, counties identified as ready must report quarterly via JBSIS; on or before January 1, 2029, all county court systems must be reporting quarterly.

Changed the Judicial Council's spreadsheet formatting frequency from every three months to every four months in the retained Section 68652.

Added a privacy protection requiring that counties with an average of 100 or fewer unlawful detainer case filings during the previous five fiscal years have their data reported only at the county level rather than ZIP Code level in the public spreadsheet.

Changed the public access mechanism from making data available through a California Public Records Act request to requiring the Judicial Council to publicly post the formatted spreadsheet on its internet website, making the data immediately accessible without a formal request.

Expanded the data points tracked in the new JBSIS-based section to include 'posttrial' judgments (previously only pretrial) and dismissals 'by order of the court' (previously only at plaintiff's request).

The Judicial Council must now publicly post the eviction data spreadsheet on its internet website rather than merely making it available upon a California Public Records Act request. This shifts from passive, request-based access to active public disclosure.

The frequency for formatting and publishing the eviction data spreadsheet was changed from every three months to every four months.

A section numbering error was corrected: the original draft contained both 'SEC. 2.' and 'SECTION 1.' for what should be a single Section 1 of the Government Code addition. The amendment removes the erroneous duplicate label.
