Pupil safety: limiting school access to unauthorized individuals.

All amendments to Education Code Section 32282 (comprehensive school safety plans) were removed from the bill. The July version contained two full rewrites of that section covering disaster procedures, fire evacuation plans, active shooter drill restrictions, cardiac arrest response protocols, opioid overdose protocols, immigration enforcement notification procedures, and instructional continuity plans. None of these remain in the August version.

The bill's title and scope were narrowed from 'amend Section 32282 of add Section 17603.5 to the Education Code' to simply 'add Section 17603.5 to the Education Code, relating to pupil safety.' The bill now contains only one operative section (the new 17603.5) plus a state mandates reimbursement provision.

A new subdivision (b) was added to Section 17603.5 stating: 'Nothing in this section shall prevent otherwise lawful access to a construction project.' This creates an explicit exemption ensuring the security requirements do not block legitimate access to ongoing construction work.

New Education Code Section 17603.5 requires governing boards or bodies of local educational agencies (school districts, county offices of education, and charter schools) to ensure that any construction contract for work taking place during school hours includes security provisions that limit access to the construction site and keep unauthorized individuals off school property.

Defines 'construction project' as all construction, alteration, demolition, installation, repair, and maintenance work performed on a schoolsite, and 'local educational agency' as a school district, county office of education, or charter school.

The bill's scope expanded from amending only Section 32282 (comprehensive school safety plan requirements) to also adding an entirely new section (17603.5) that creates a direct contractual obligation on construction projects, making the security requirement enforceable at the contract level rather than only through safety planning.

Mandate reimbursement provision retained: if the Commission on State Mandates determines the bill contains state-mandated costs, reimbursement to local agencies and school districts shall be made pursuant to Part 7 (commencing with Section 17500) of Division 4 of Title 2 of the Government Code.
