School facilities: design-build: shade structures.

Procedural formatting change: the bill was reformatted from the Amended Assembly version (with amendment dates and Senate bill header) to the Enrolled version (with passage dates for both chambers and a Governor's signature block). No changes to the operative statutory text were made.

Removed the phrase 'including, but not limited to, shade structure projects' from both the digest and Section 17250.20(a)(2), making the bundling provision apply specifically to comparable shade structure projects rather than a broader category.

New Section 1.5 adds an alternative version of Section 17250.20 that would grant county superintendents of schools the authority to procure design-build contracts for projects over $1,000,000 and gives them exclusive authority to award such contracts on behalf of a county office of education and county board of education.

New Section 3 establishes the operative conditions for Section 1.5: it only takes effect if both SB 1107 and AB 1860 are enacted and effective on or before January 1, 2027, each amends Section 17250.20, and SB 1107 is enacted after AB 1860. If those conditions are met, Section 1 of this bill does not become operative.

The former Section 3 (no reimbursement required) was renumbered as Section 4 to accommodate the new sections.

Bundled design-build procurement is now limited to comparable shade structure projects only, rather than any comparable projects at various sites. This removes the ability to bundle non-shade-structure projects under this authority.

A sunset date of December 31, 2031 is added. School districts may only enter into bundled contracts on or before that date, though a contract entered into by that date may be completed afterward.

An upper cap of $10,000,000 is added to the total value of projects that can be bundled through a single solicitation. Previously there was only a $1,000,000 minimum with no stated maximum.

The state-mandated local program designation changed from 'no' to 'yes,' which affects whether the state must reimburse school districts for costs imposed by this act.

New Section 17250.20(a)(2) allows school districts to bundle multiple design-build contracts for comparable projects at various sites (including shade structures) through a single solicitation if the total value exceeds $1,000,000, even when individual project values are below that threshold. Each bundled contract must remain separate with its own scope, location, schedule, and construction plan.

The Senate version included a legislative intent section (former Section 1) expressing the Legislature's intent to enact subsequent legislation to increase affordability of heat-reducing shade structures. The Assembly removed this entirely.

The bill's scope expanded from amending only Section 17671 to also amending Section 17250.20 of the Education Code, broadening it from a shade-structure-specific bill to one covering general design-build procurement for school districts.

New Section 17250.20(b) requires school districts to develop guidelines for a standard organizational conflict-of-interest policy governing whether entities that perform services for the district in soliciting design-build projects can also submit proposals or join design-build teams.

The Assembly reverted the accessibility path-of-travel compliance cost cap in Section 17671 back to 20% of adjusted construction cost, rejecting the Senate's increase to 25%. This means shade structure projects will not receive the higher cost allowance for accessibility improvements that the Senate had approved.

A new Section 3 provides that no state reimbursement is required under Article XIII B of the California Constitution, citing creation or change of a crime as the reason (standard boilerplate language).

Shade structures integrated with playground equipment are now included as an eligible project type, expanding beyond only freestanding, open-sided shade structures.

A new 20% cap on path-of-travel compliance costs is established specifically for shade structures integrated with playground equipment, which is lower than the 25% cap applied to freestanding structures.
