Pupils: foster youth: access to pupil records.

Removed 'AMENDED IN ASSEMBLY' headers and replaced with final enrolled bill formatting including chamber passage dates and clerk signatures.

Added procedural language indicating the bill was passed by the Senate on August 27, 2026 and by the Assembly on August 24, 2026, along with Governor receipt language.

New Section 1.5 adds a conditional alternative amendment to Education Code Section 49076 that incorporates changes proposed by AB 2478. It only becomes operative if both bills are enacted by January 1, 2027 and SB 1017 is enacted after AB 2478.

In the new Section 1.5 version of subparagraph (O), access to pupil records for foster youth is expanded to include 'a kinship family, as defined in Section 16519.4 of the Welfare and Institutions Code' and 'a tribally approved home, as defined in subdivision (r) of Section 224.1 of the Welfare and Institutions Code,' in addition to the previously listed foster parents, relative or nonrelative extended family members, and resource families.

In the new Section 1.5 version, 'nonrelated extended family member' is changed to 'nonrelative extended family member' in subparagraph (O), aligning with statutory terminology used elsewhere in the Welfare and Institutions Code.

A drafting artifact appears in the new Section 1.5 financial aid provision (subparagraph B of paragraph 2), where 'his or her the pupil's parents' appears instead of simply 'the pupil's parents,' likely a leftover from editing.

New Section 3 establishes three conditions that must all be met for Section 1.5 to become operative: both bills enacted and effective by January 1, 2027; each bill amends Section 49076; and SB 1017 is enacted after AB 2478. If these conditions are met, Section 1 of SB 1017 shall not become operative.

Subsection (L) now reads 'a pupil 14 years of age or older who meets both of the following criteria' instead of simply 'or who meets both of the following criteria,' making it grammatically explicit that the age threshold applies to the homeless student category as well, not just foster youth.

Subsection (B) on financial aid disclosure removed the redundant phrase 'his or her' that remained from a prior edit, now reading 'a pupil or the pupil's parents' instead of 'a pupil or his or her the pupil's parents.'

The legislative counsel's digest was reorganized: the Commission on State Mandates reimbursement language was moved to a different position within the digest. No substantive content was added or removed.
