Mobilehomes: cooling systems.

A new exception was added (subparagraph B) allowing management or ownership to prohibit a cooling system if a permit from a designated permitting authority is required and that permit has not been granted. This gives park managers and HOAs a new basis to deny cooling installations.

The legal-violation exception was broadened from 'would violate federal, state, or local government building standards' to 'would violate federal, state, or local law,' making it easier for management to cite a violation as grounds for prohibiting a cooling system.

The standard for cooling common areas during an Extreme Heat Warning was changed from compliance with Department of Industrial Relations indoor heat illness prevention standards to a specific maximum room temperature of 78 degrees Fahrenheit, providing a clearer but potentially different threshold.

The power/amperage exception now applies to the power service to 'the park, lot' rather than just 'the park,' extending the ability to deny cooling based on insufficient electrical capacity down to the individual lot level.

The exception language was changed from 'demonstrates the establishes either of the following' to 'establishes either any of the following,' and the tenancy termination protection was renumbered from subdivision (e) to (d) in both sections, with liability and attorney's fee provisions shifted accordingly.

The bill header changed from the enrolled format (showing Assembly and Senate passage dates with blank Governor receipt line) to the authenticated chaptered format showing 'STATE OF CALIFORNIA AUTHENTICATED ELECTRONIC LEGAL MATERIAL' and 'CHAPTER 343' with the approval date of October 6, 2025.

Page numbering was adjusted (from page 95 to page 94 in some locations) and line breaks were reformatted throughout the statutory text to match the official chaptered layout.

Removed the requirement that mobilehome parks with designated indoor common areas must provide cooling to at least one such area during an Extreme Heat Warning, available 9 a.m. to 9 p.m., cooled to a maximum of 78 degrees Fahrenheit, free of charge and without usage restrictions.

Removed the parallel requirement for subdivisions, cooperatives, condominiums for mobilehomes, and resident-owned mobilehome parks to provide cooled indoor common areas during Extreme Heat Warnings.

Simplified the amperage exception by removing the reference to 'the common area cooling system as described in subdivision (d)' and changing 'power service to the park, lot' to 'power service to the lot,' consistent with the removal of the common area cooling requirement.

Removed the word 'either' from the exceptions clause ('establishes either any of the following' changed to 'establishes any of the following'), a minor drafting correction.

The word 'replacement' is added alongside 'installation, upgrade, or use' in every provision, explicitly protecting residents' right to replace existing cooling systems without interference from park management or ownership.

The exception allowing management to block a cooling system is restructured into two separate grounds: (A) violation of federal, state, or local building standards or law (federal law newly added), and (B) insufficient power capacity. The power capacity defense now requires written demonstration by a federal, state, or local governmental enforcement authority, making it substantially harder for management to invoke.

Common area cooling during an Extreme Heat Warning is now required each day between 9 a.m. and 9 p.m., with explicit prohibitions on charging entry fees, restricting duration of use within those hours, or creating any other barrier to effective resident access.

The temperature standard for cooled common areas changes from referencing the Department of Industrial Relations indoor heat illness prevention standards to a specific maximum room temperature of 78 degrees Fahrenheit.

The term 'extreme heat warning' is changed to 'Extreme Heat Warning' (capitalized) to match the official National Weather Service product name, and the trigger language is clarified from 'declaration of an extreme heat warning' to 'issuance of an Extreme Heat Warning.'

The bill now covers 'installation, upgrade, or use' of cooling systems instead of just 'installation or use,' broadening protections to residents who want to replace or improve existing units.

A new prohibition was added making it unlawful for management to require homeowners or residents to remove cooling systems or to prevent replacements or upgrades to existing cooling systems.

The common area cooling trigger changed from simply exceeding Department of Industrial Relations temperature guidelines to requiring both a National Weather Service extreme heat warning declaration for the park's area AND temperatures exceeding those guidelines. Cooling must now be provided 'for the duration of the extreme heat warning.'

The common area cooling requirement was narrowed from 'that common area' (implying all common areas) to 'at least one common area,' with new rules specifying that if multiple indoor common areas exist, the park must cool either an area large enough for at least 50 percent of the resident population based on maximum occupancy load, or the largest available ADA-accessible indoor common area.

A new exception was added: the prohibitions do not apply if management demonstrates that the installation, upgrade, or use would violate state or local government building standards or require amperage that cannot be accommodated by the power service to the park. This gives parks a legal basis to deny cooling installations when electrical infrastructure is insufficient.
