Dams: exceptions.

A new subsection (b)(2) limits the weir exclusion to only nine named weirs: Peoples Weir, Reynolds Weir, Last Chance Weir, Lemoore Diversion Weir, Island Weir, Crescent Weir, Stinson Weir, Empire Weir No. 1, and Empire Weir No. 2.

The general exclusion criteria in subsection (b)(1) no longer requires the barrier to have 'mechanically or manually removable flashboards or gates' - it now only requires that the barrier is a weir with three feet of freeboard on the levee.

The definition of 'weir' in subsection (c) was cleaned up to remove a redundant phrase ('removable barriers either') and now reads more clearly as 'with either mechanically or manually removable flashboards or gates.'

The bill moved from 'Amended in Senate' status to 'Enrolled' status, reflecting that it passed the Assembly on September 4, 2025 and the Senate on September 3, 2025. Line number markers were removed and the text was reformatted into standard enrolled bill layout.

A duplicate word in the legislative counsel's digest was corrected: 'as defined. defined, but would' became 'as defined, but would.' This is a typo fix with no policy impact.

The definition of 'weir' in Section 6003(c) was changed from 'an agricultural water delivery structure with removable barriers' to 'an agricultural water delivery structure with removable barriers either mechanically or manually removable flashboards or gates.' This narrows the exception so that only structures with specifically flashboard or gate-type removable barriers qualify as weirs exempt from the dam definition.

Removed redundant wording in Section 6003(a): 'Any such barrier which barrier that is' became 'Any barrier that is' and 'or which that has' became 'or that has.' No substantive policy change.

The bill was assigned Chapter 617 and the gubernatorial approval date of October 11, 2025 was recorded in place of the previously blank signature lines.
