Local ordinances: administrative fines or penalties.

Summary
Existing law authorizes the legislative body of a local agency, as defined, to, by ordinance, make any violation of an ordinance subject to an administrative fine or penalty. Existing law requires a local agency to set forth, by ordinance, the administrative procedures that govern the imposition, enforcement, collection, and administrative review of those administrative fines or penalties, as specified. This bill would, for specified administrative fines or penalties, authorize a local agency to, subject to specified requirements, file a certified copy of a final administrative order or decision that directs payment of the administrative fine or penalty with the clerk of the superior court of any county, as specified, and require the clerk to enter judgment immediately in conformity with the decision or order. The bill would also authorize a local agency to, by ordinance, establish a procedure to collect administrative fines or penalties by lien upon the parcel of land on which the violation occurred if the ordinance meets specified requirements. The bill would specify that the remedies or penalties provided by these provisions are cumulative of the remedies or penalties available under any other law.

REQUIREMENT

Lien notice requirements in subdivision (f) were simplified. The old version required service of both an initial notice of violation and a separate notice of lien, and specifically enumerated the parties to be served (owner of record based on assessment roll, and owner of encumbrance of record). The new version only requires that the property owner be served with a notice of lien at least 20 days before recordation. The explicit statement that those parties are entitled to seek administrative review was also removed.

The mail service time extension rule in subdivision (f)(3)(B) was substantially changed. The old version stated that service by mail did NOT extend any notice periods and explicitly excluded CCP Section 1013 from applying. The new version provides graduated extensions: 5 calendar days if both mailing and address are in California, 10 days if either is outside California but within the US, 12 days for addresses under the Secretary of State's address confidentiality program, and 20 days if either location is outside the United States.
