Nevaeh Youth Sports Safety Act.

New subdivision (e)(1) states the section shall not be construed to require a public or private local facility or its employees to procure or install an AED, or to operate or administer an AED during a cardiac emergency or suspected cardiac emergency.

New subdivision (e)(2) states the requirements do not impose a mandatory duty under Government Code Section 815.6 and do not affect any immunity otherwise applicable to the public or private local facility or its employees.

Removed two empty subsection numbers (former paragraphs (3) and a duplicate (4)) from subdivision (a), renumbering subsequent paragraphs accordingly.

The requirement for public or private local facilities to procure and maintain an AED was changed from mandatory ('shall') to permissive ('may'), making it optional for facilities to install their own AED.

A new provision states that a facility already maintaining or testing an AED pursuant to another statutory requirement is deemed to have met the AED maintenance and testing requirement, creating a compliance shortcut for facilities subject to other AED laws.

A new exception for local educational agencies (schools) was added. A school's existing AED only counts if it is in the same common area of the building or the same outdoor field where the practice or match occurs, or attached externally and reasonably accessible. Schools are also explicitly not required to have staff remain onsite to provide AED access to youth sports organizations.

The January 1, 2028 commencement date was removed from subdivision (d), which requires facilities to collaborate with youth sports organizations on AED accessibility and cost-sharing. These collaboration duties now take effect immediately rather than being delayed until 2028.

The cost-sharing obligation was expanded. Previously it covered sharing costs of ensuring an AED is 'installed or accessible.' Now it covers sharing costs of ensuring the AED is 'maintained and accessible' OR identifying means to share costs associated with 'installing an AED at the facility,' broadening the scope of what can be shared.

The entire amendment to Code of Civil Procedure Section 219, which would have prohibited probation officers from being selected for voir dire in criminal matters, was deleted. The bill no longer touches jury selection.

A new Health and Safety Code Section 124238 was added providing definitions for 'coach,' 'official practice or match,' 'permanent sports infrastructure,' and 'youth sports organization.'

The deadline for youth sports organizations to ensure AED access during official practices or matches was changed from January 1, 2027 to January 1, 2028.

Commencing January 1, 2027, youth sports organizations must ensure coaches are certified (and recertified every two years) in CPR and AED operation, and must maintain a written cardiac emergency response plan that is reviewed annually with coaches and staff.

The written cardiac emergency response plan must detail AED locations and procedures for sudden cardiac arrest, responsibilities of coaches/administration/athletes, notification and training methods, and include an annual electronic communication to parents or guardians with the plan, AED locations, and designated staff contacts.

Commencing January 1, 2028, public or private local facilities and youth sports organizations must ensure their AED is maintained and tested according to manufacturer guidelines and applicable FDA or other federal/state rules.

Commencing January 1, 2028, a public or private local facility must work in collaboration with the youth sports organization to ensure an AED is installed or accessible at the facility.

A fallback provision was added: if no AED is available at the facility where a practice or match is taking place, the youth sports organization must ensure access to an operational AED that is available during the entire practice or match.

Commencing January 1, 2028, a public or private local facility must work with the youth sports organization to identify means to share the financial costs of ensuring an AED is installed or accessible at the facility.

The initial AED access deadline was moved from January 1, 2027 to January 1, 2028, aligning all requirements under a single compliance date. The coach CPR/AED certification requirement in subsection (b) had its 'commencing January 1, 2027' language removed, meaning it now takes effect on the bill's operative date rather than being delayed.

The obligation for public or private local facilities to procure and maintain an AED was changed from mandatory ('shall') to permissive ('may'). If a facility does choose to procure and maintain an AED, it must then ensure the youth sports organization has access to it.

The collaboration requirement in subsection (d)(1) was narrowed: facilities must now work with youth sports organizations specifically to ensure any installed AED is accessible at the time of official practices or matches permitted by the facility, rather than a broader obligation to ensure an AED is installed or accessible.

The cost-sharing requirement in subsection (d)(2) now applies only to facilities that have actually installed an AED, and the scope was expanded to include costs of maintaining the AED, not just installing it.

A duplicate paragraph label '(c)' in the definitions section was corrected to proper sequential numbering (c) and (d).

Added a new section amending Health and Safety Code Section 124238.5 (Nevaeh Youth Sports Safety Act). Starting January 1, 2027, youth sports organizations must ensure athletes have access to an AED during official practices or matches, but only at locations where an AED already exists or at public/private local facilities with permanent sports infrastructure used for youth sports.

Narrowed the probation officer exclusion from jury selection: changed from 'civil or criminal matters' to only 'criminal matters,' meaning probation officers can now be selected for voir dire in civil cases.

The public or private local facility with permanent sports infrastructure used for youth sports is responsible for procuring and maintaining the AED and ensuring the youth sports organization has access to it.

Added a requirement that if an AED is administered during a medical circumstance, it must be administered by a medical professional, coach, or other designated person who holds AED certification and complies with applicable federal and state law.

Defined 'permanent sports infrastructure' as a fixed, nontemporary facility or structure designed and maintained for hosting organized sports activities.

Corrected a double negative in subdivision (b)(1) and (b)(2) by removing the word 'no' before 'a peace officer.' The original language read 'no a peace officer... shall not be selected,' which is grammatically contradictory. The amendment clarifies the intended meaning: peace officers are excluded from voir dire selection.
