AB 2762 California Assembly · 2025-2026 Regular Session

Electrical corporations and gas corporations: rates.

Summary
Existing law vests the Public Utilities Commission with regulatory authority over public utilities, including electrical corporations and gas corporations. Existing law authorizes the commission to fix the rates and charges for every public utility and requires that those rates and charges be just and reasonable. Existing law requires the commission, for purposes of establishing rates for any electrical corporation or gas corporation, to disallow expenses reflecting the direct or indirect costs resulting from any unreasonable error or omission relating to the planning, construction, or operation of any portion of the corporation's plant that cost, or is estimated to have cost, more than $50,000,000, including any expenses resulting from delays caused by any unreasonable error or omission, as specified. This bill would make nonsubstantive changes to that requirement.

MODERATE
AB 2762 makes purely nonsubstantive drafting and stylistic edits to Section 463 of the Public Utilities Code. The core policy - requiring the Public Utilities Commission to disallow expenses from unreasonable errors or omissions on utility plant projects exceeding $50 million - is unchanged. Changes include replacing passive phrasing with active voice, removing a stray word ('situation'), and cleaning up redundant sub-numbering in definitions.
TECHNICAL

In subsection (a), 'Nothing in this section prohibits' was changed to 'This section does not prohibit,' and 'is a clarification of' was changed to 'clarifies,' and 'is not intended to limit or restrict' was changed to 'does not limit or restrict.' These are stylistic rewordings with no change in legal effect.

In subsection (b), 'does not apply where the commission determines' was changed to 'does not apply if the commission determines,' a minor grammatical adjustment with no substantive impact.

In subsection (c) introductory text, the word 'situation' was removed and the colon was replaced with a comma: 'For purposes of this section: situation, all of the following definitions apply' became 'For purposes of this section, all of the following definitions apply.'

In the definitions of 'Error' and 'Omission,' 'which causes' was changed to 'that causes,' and redundant roman numeral sub-numbering (i), (ii), (iii), (iv) was removed, leaving only the letter designations (A), (B), (C), (D).
