Header updated from 'Amended in Senate' to enrolled format showing passage by the Assembly on August 26, 2026 and the Senate on August 25, 2026, with a blank date for the Governor's receipt.

The coauthor credit (Assembly Member Alanis) and the original introduction date (February 20, 2026) were removed, as is standard when a bill becomes enrolled.

The legislative counsel's digest was reformatted: line breaks adjusted and the state-mandated local program reimbursement language was moved from the bottom of page 2 into the digest section itself.

The 'Vote: majority. Appropriation: no. Fiscal committee: yes. State-mandated local program: yes.' line was removed, as is standard for enrolled bills.

The body text of Section 1 and Section 2 was reformatted from numbered-line style to standard paragraph format with no changes to the actual legal language.

The definition of 'drive' in new Vehicle Code Section 23152.1 no longer references SAE Levels 0 through 3. Instead, it uses a functional test: the vehicle must have driver support features engaged that require a person to supervise steering, braking, or acceleration to maintain safety.

A new exclusion was added stating that 'drive' does NOT include operating a vehicle with driver support features that do not require a person to supervise steering, braking, or accelerate and will not request a person to take direct control. This effectively excludes Level 4 and Level 5 autonomous vehicles from the DUI definition.

The amendment date was updated from July 2, 2026 to August 21, 2026, with the prior date retained as a secondary line. Page numbers were renumbered from 98 to 97 due to formatting adjustments.

The definition of 'drive' for DUI purposes now includes not only SAE Level 0-3 driving automation but also 'driver support features engaged that require a person to supervise the vehicle in order to steer, brake, or accelerate, as needed to maintain safety.'

New clarifying language specifies that the covered driver support features include those requiring constant supervision and those requiring a person to take direct control of the vehicle upon the request of the feature.

The digest language was softened from 'this bill would expand the scope of a crime' to 'to the extent that this bill would expand the scope of a crime,' hedging the state-mandated local program finding.
