New subsection (b) defines 'directly communicate' as using GenAI instead of a natural person to communicate directly with a specific member of the public or to make a general public announcement.

Explicit exclusion: 'directly communicate' does not mean using GenAI to assist in drafting a communication, so AI-assisted writing by humans no longer triggers the disclaimer requirement.

The triggering condition changed from 'utilizes GenAI to communicate with the public' (Assembly) to 'utilizes GenAI to directly communicate with the public' (Senate), narrowing applicability through the new definition.

Subsection structure was reorganized: former top-level (a) and (b) became (a)(1) and (a)(2), with internal sub-items renumbered from (1)-(4) to (A)-(D).

The trigger for the GenAI disclaimer requirement was expanded from 'directly communicate with a person regarding government services and benefits' to 'communicate with the public, including through both individualized direct communications and general public announcements.' This means state agencies must now label AI-generated content in broad public-facing communications (like press releases or website updates), not just one-on-one service interactions.

Assembly Member Dixon was added as a coauthor of the bill.

In subsection (a)(3) covering audio communications, the word 'verbally' was changed to 'orally.' This is a minor wording change with no substantive policy impact.
