Cemeteries: removal of remains.

Section 103050 of the Health and Safety Code was struck entirely. That section had made technical changes to rules about death certificates, permits for disposition, and coroner authority to release remains to out-of-state funeral establishments near the border (within 50 miles of the California border with a licensed establishment within 30 miles of the county border).

The legislative counsel's digest was updated to remove all references to human remains disposition and cross-border transport, now describing only the cemetery removal provision.

Procedural header changed from enrolled bill format (passage dates, clerk signatures, governor receipt time) to chaptered format with 'STATE OF CALIFORNIA AUTHENTICATED ELECTRONIC LEGAL MATERIAL,' chapter number 74, and the approval/filing date of July 13, 2026.

New amendment to Health and Safety Code Section 7526 adds the requirement that a court shall grant an application for removal of interred remains upon a showing of good cause when the required consent from surviving family members cannot be obtained. Previously the law only stated that superior court permission was sufficient in such cases without specifying a standard.

In Section 103050(b)(2), 'he or she the coroner' was changed to 'the coroner,' removing gendered language.

In Section 103050(c), 'Nothing in this This section shall does not exempt' was corrected to 'This section does not exempt,' fixing a drafting error with contradictory phrasing.

In Section 103050(c), 'any provision of the Health and Safety Code or the California Code of Regulations' was shortened to 'the Health and Safety Code or the California Code of Regulations.'
