The entire legislative findings and declarations section was removed. This section contained five numbered findings about the workforce system, stated legislative intent to authorize a unified subgrant mechanism for federal and state funds, declared intent to allow EDD to issue directives outside the Administrative Procedure Act, listed four policy objectives (efficiency, nimbleness, consistency, transparency), and directed EDD to develop implementation procedures in consultation with local boards.
A new definition was added to Section 14003.5(a) defining 'Grants or subgrants' as allocations of both federal- and state-source funds awarded by EDD to local workforce development boards or their fiscal agents, treated as grants or subventions for public purposes. This clarifies that the exemptions from the Public Contract Code and DGS review apply to both federal and state funding streams.
The state-mandated local program designation changed from 'no' to 'yes,' meaning the bill now triggers California's constitutional requirement for the state to reimburse local agencies for costs mandated by the state. The fiscal committee vote also changed from 'no' to 'yes.'
