Pest control: Pierce's disease.

All fixed sunset dates (March 1, 2036) are removed. The Pierce's Disease Control Program, the Winegrape Pest and Disease Prevention Board, the advisory task force, and related provisions now operate indefinitely unless terminated through the new hearing and referendum process.

Section 6047.27(a)(1) changes the inoperative date from a fixed date (March 1, 2026) to a dynamic date: March 1 of the calendar year immediately following the calendar year in which the referendum is held.

Section 6047.19(c), which contained the fixed sunset date for the reporting requirements (March 1, 2036), is removed entirely, making annual reporting obligations indefinite.

Section 6047.20 is restructured from a sunset-with-referendum-exception provision into a standing requirement that the secretary hold public hearings no later than June 30, 2030, and at least once every five years thereafter to determine whether the article should continue.

Section 6047.23 removes the requirement that at least 40 percent of persons on the eligible voter list must participate in the referendum for it to be valid. Only the approval thresholds (65 percent of voters plus majority of assessment dollars, or majority of voters plus 65 percent of assessment dollars) remain.

Section 6047.21(a) now requires the secretary to first determine whether a 'substantial question of opposition' exists among affected producers after the hearing. If no substantial opposition is found, the article continues without a referendum. The voter list is only established if substantial opposition is found.

Section 6047.3.5 changes the research purpose from 'eradication of Pierce's disease' to 'prevention of Pierce's disease and other designated pests and diseases,' broadening the scope of contracted research.

The board is formally renamed from 'Pierce's Disease and Glassy-winged Sharpshooter Board' to 'Winegrape Pest and Disease Prevention Board,' reflecting its broader mandate beyond a single disease and vector.

The entire Tri-Valley-San Joaquin Valley Regional Rail Authority provision (amending Public Utilities Code Section 132655) is removed. This had required a City of Mountain House representative on the rail authority governing board instead of a Mountain House Community Services District representative.

Multiple provisions are expanded to cover 'other designated pests and diseases' in addition to Pierce's disease, including the advisory task force, annual reporting requirements, and research contracting authority. A new definition of 'Other designated pests and diseases' is added, meaning pests and diseases designated by the secretary under Section 6047.30.

Senator McNerney is removed as principal coauthor, leaving only Assembly Members Aguiar-Curry, Alanis, Jeff Gonzalez, and Hadwick as coauthors.

The Pierce's Disease and Glassy-winged Sharpshooter Board is renamed to the Winegrape Pest and Disease Prevention Board, reflecting its expanded mandate.

A new Section 6047.2 is added providing definitions for Board, Department, Marketing season, Producer, Processor, Person, Purchase, Purchased grapes, Grapes not purchased, Secretary, and Other designated pests and diseases.

A new Section 6047.3 establishes the board composition: at least 14 but not more than 15 members, including 8 producer representatives who are not also processors, 6 processor representatives who are also producers, and one public member appointed from board nominees.

A new Section 6047.3.5 authorizes the secretary, upon board recommendation, to contract with nonprofit scientific bodies to expedite research on Pierce's disease and other designated pests and diseases.

Section 6047.20 is repealed and re-added. The new version requires the secretary to hold public hearings no later than June 30, 2030, and at least once every 5 years thereafter, to determine whether the article's operation should continue.

Section 6047.21 is restructured. If the secretary finds after a hearing that no 'substantial question of opposition' exists among affected producers, the article continues without a referendum. If substantial opposition exists, a referendum is conducted. A new definition clarifies that 'substantial question of opposition' means opposition to the substance among currently affected producers and does not require a particular number.

A new Section 6047.22 limits voting rights in the referendum to persons required to pay the assessment under Section 6047.8.

A new Section 6047.23 establishes specific voting thresholds for a favorable referendum result: at least 40% participation is required, and either (a) 65% or more of voters in favor AND those voters paid a majority of assessment dollars, or (b) a majority of voters in favor AND those voters paid 65% or more of assessment dollars.

Section 6047.27 is modified so that if the referendum is unfavorable, the article becomes inoperative as of March 1 of the calendar year immediately following the calendar year in which the referendum is held, rather than on a fixed date.

A new Section 6047.31 provides that if the article becomes inoperative pursuant to Section 6047.27, it shall be fully repealed as of January 1 of the calendar year following the calendar year that Section 6047.29 (the advisory task force) becomes inoperative.

Section 6046 gains a new subsection (i) providing that if Article 8.5 becomes inoperative due to an unfavorable referendum, Section 6046 also becomes inoperative on the fifth calendar year following the referendum year.

The appropriation determination changes from 'no' to 'yes,' and the state-mandated local program determination changes from 'yes' to 'no' (reflecting removal of the Mountain House rail provision).

Entirely new set of provisions (Sections 6046, 6047.19, 6047.20, 6047.21, 6047.27, and 6047.29 of the Food and Agricultural Code) extending the Pierce's Disease Control Program, Management Account, industry board, and advisory task force from March 1, 2031 to March 1, 2036.

The state-mandated local program designation changed from 'yes' to 'no,' likely reflecting restructured mandate language in the amended bill.

A referendum mechanism is added: the program provisions become inoperative on March 1, 2031 unless the Secretary of Food and Agriculture finds a favorable vote. The secretary must establish a list of eligible voters by April 15, 2030, limited to producers, processors, and persons who paid the grape assessment in the immediately preceding season.

The bill now makes an appropriation (changed from 'no' to 'yes') because it extends the operation of a partially continuously appropriated fund (the Pierce's Disease Management Account) for five additional years.

Legislative findings were added to satisfy California's constitutional requirement (Article I, Section 3) for statutes that limit public access to meetings or writings of public bodies, specifically regarding Sections 6047.5 and 6047.13.

The original rail authority provision (changing Mountain House Community Services District to City of Mountain House on the governing board) was retained but renumbered from Section 1 to Section 8, with formatting adjustments throughout.
