The entire amendment to Penal Code Section 1001.36 was removed. This provision would have made a defendant ineligible for pretrial mental health diversion if the facts alleged in the accusatory pleading or disclosed in police reports, preliminary hearing transcripts, or other evidence would constitute certain serious offenses (murder, sex offenses requiring registration, rape, lewd acts on children under 14, assault with intent to commit rape, continuous sexual abuse of a child, etc.), regardless of whether those offenses were formally charged. This closed a potential loophole where prosecutors could file lesser charges while the underlying conduct involved serious crimes.

The bill's stated purpose narrowed from 'to amend Section 1001.36 of, and to add Section 266l to, the Penal Code' to simply 'to add Section 266l to the Penal Code.' The legislative counsel digest title changed from 'Crimes: plea deals and diversion' to 'Crimes: plea deals.'

The requirement that any plea agreement or disposition for human trafficking (Section 236.1(b) or (c)) or prostitution/pandering (Sections 266h or 266i) involving a minor victim must result in at least five years in state prison actually served, without suspension, probation, or alternative custody, was removed. The only exception was if the court found on the record by clear and convincing evidence that extraordinary circumstances outweighed the need to protect child victims and the public.

Added 'anonymity' to the list of dispositions that cannot be granted to any person other than the defendant in plea agreements involving minor victims of trafficking or pimping crimes, unless that person is specifically named and the court approves after a hearing with victim notice. This closes a potential loophole where a plea deal could shield a third party by keeping their identity secret rather than granting formal immunity.

Corrected 'A defendant may shall not be placed into a diversion program' to 'A defendant shall not be placed into a diversion program' for the list of serious offenses (murder, sex offender registration offenses, rape, lewd acts on children under 14, assault with intent to commit rape, conspiracy to commit rape, continuous sexual abuse of a child, and certain human trafficking violations). The original text contained both 'may' and 'shall not,' creating ambiguity; the amendment makes the prohibition clear and mandatory.

Reformatted the list of offenses ineligible for pretrial diversion from a nested numbered-and-lettered structure (items 1-8 with sub-items A-H) to a flat lettered list (A-H), removing redundant numbering. No substantive change to which offenses are covered.

Renumbered the state mandates reimbursement section from Section 5 to Section 4, with a blank Section 5 left above it, likely reflecting removal or reorganization of another section during amendment.
