Corrections: jail administrators.

The interim jail administrator provision was deleted. Previously, if a county established the position but had not yet confirmed a candidate, the nominated candidate would automatically serve as interim jail administrator during the board's review period. This is no longer the case.

The board's confirmation or denial vote no longer needs to be taken 'by resolution.' The old text required confirmation 'by resolution majority vote'; the new text requires only a 'majority vote.' This removes a formal procedural step.

Subdivisions were renumbered (old f through i became e through h) and cross-references updated to reflect the removal of the interim provision. The term-length provision no longer references interim jail administrators, only acting ones.

The board of supervisors must now approve establishment of the jail administrator position by majority vote, rather than simply by resolution with no specified threshold.

The board must confirm or deny a candidate by majority vote within 60 days of submission, adding an explicit voting threshold to the confirmation process.

A new provision requires the board to hold a public hearing on jail operations before making a decision to confirm or deny a candidate's appointment.

The sheriff must now nominate a 'qualified candidate' rather than simply 'a candidate,' adding an implicit qualification standard to the nomination.

The vacancy-filling procedures (acting jail administrator, 150-day limit, 60-day extensions) now apply only to vacancies occurring after the board's initial decision to confirm or deny a candidate, excluding the initial filling of the position from those procedures.

References to 'new candidate' were changed to simply 'candidate' in multiple provisions, and 'acting interim jail administrator' was simplified to 'interim jail administrator.'

All amendments to Government Code Section 23013 were removed. This eliminated the framework for establishing a 'department of corrections and rehabilitation' headed by an executive officer, including provisions on qualifications (corrections management experience, familiarity with Title 15 regulations, commitment to civil rights), duties (assuming sheriff's duties, ensuring personnel meet minimum requirements), joint county departments, and the requirement that a board set forth reasons for establishing such a department.

The legislative intent statement (former Section 1) was removed, which had stated that amendments would not require workforce changes at county jails, industrial farms, or fire or road camps, and that existing peace officers could maintain their status.

Section 26605(b)(2) previously exempted counties that had established a department of corrections and rehabilitation under Section 23013 from the sheriff's exclusive authority over county jails. That exemption was removed along with the Section 23013 amendments, leaving only the exemption for counties that have appointed a jail administrator under Section 23016.

In Section 23016(c)(2), the phrase 'including, but limited to' was changed to 'including, but not limited to,' making the list of factors the board may consider when confirming or denying a jail administrator candidate non-exhaustive rather than exhaustive. This gives boards broader discretion in their confirmation decisions.

Section 23016(f)(2)(B) was expanded to clarify that time spent as either an interim jail administrator (under subdivision e) or an acting jail administrator (under subdivision h(1)) does not count toward the three-year term, broadening the prior language which only referenced the acting appointment under subdivision (h).

Section 23016(e) was narrowed: the interim/acting provision now only applies to a position that 'has never been filled' rather than any nominated candidate. The term was also changed from 'acting jail administrator' to 'acting interim jail administrator,' distinguishing it from the 'acting jail administrator' appointed during vacancies under subdivision (h).

New Government Code Section 23016 creates a 'jail administrator' position that any county board of supervisors may establish by resolution, providing an alternative to the full department of corrections and rehabilitation under Section 23013.

The jail administrator serves a three-year term and has executive authority over all county jails with supervisory authority over all staff and incarcerated individuals. If a peace officer, they retain that status to the extent allowed by Penal Code Section 830.1.

Government Code Section 26605(b) is expanded so that the sheriff's sole and exclusive authority to keep the county jail no longer applies not only in counties with a department of corrections and rehabilitation, but also in counties that have appointed a jail administrator under the new Section 23016.

The sheriff must nominate a jail administrator candidate within 90 days of the position being established. The board must confirm or deny within 60 days, considering factors such as corrections management experience, budget management, familiarity with Title 15 regulations, medical/mental health care requirements, civil rights commitment, and evidence-based rehabilitation knowledge.

If the board denies a candidate, the sheriff must submit a new nomination within 60 days. A nominated but unconfirmed candidate serves as acting jail administrator during the review process.

The sheriff retains authority to supervise, direct day-to-day operations of, evaluate, discipline, or remove the jail administrator, preserving significant oversight even after appointment.

Vacancy procedures require the sheriff to appoint an acting jail administrator within three days. The acting administrator serves up to 150 days, extendable by the board in 60-day increments. The sheriff may nominate a replacement up to six months before a term expires.

New Penal Code Section 4034 provides that for purposes of the chapter on jail-keeping requirements and duties, 'sheriff' includes a jail administrator appointed under Government Code Section 23016.

New Section 1 states it is the intent of the Legislature that the amendments do not require a change in workforce at county jails, industrial farms, and fire or road camps, and that existing peace officers working in those facilities may maintain their status as peace officers.

Section 23013(a) now explicitly states that a county department of corrections and rehabilitation may employ peace officers as described in Chapter 4.5 (commencing with Section 830) of Title 3 of Part 2 of the Penal Code.

Section 23013(d) now requires the executive officer to ensure that personnel, including peace officers, working in a county jail, industrial farms, and fire or road camps meet all minimum requirements and are assigned in compliance with the law.

Section 23013(a) changes the term 'prisoners, incarcerated persons' to simply 'incarcerated persons,' removing the redundant reference to prisoners.

Section 26605(a) removes the embedded exception for counties where the sheriff was not in charge as of July 1, 1993, from the main text of subdivision (a). That exception remains only in subdivision (b)(1), making the structure clearer.

Sections are renumbered: the original Section 1 (amending GC 23013) becomes Section 2, and the original Section 2 (amending GC 26605) becomes Section 3, to accommodate the new introductory section.
