New Penal Code Section 5036 applies to all new contracts and renewals entered into by CDCR on or after January 1, 2027, for services that are 'customarily and historically performed by civil service employees.'

CDCR must disclose 14 specific data points for each covered contract, including: description of services and job functions, whether the contractor has been found liable for labor law violations in the past five years, job titles and classifications used by the contractor, minimum qualifications and credentials required, corresponding state civil service classifications, affected bargaining units, number of contracted workers by classification, total expected hours, full-time equivalent value, hourly rates paid, total contract value (annual and cumulative over contract life), administrative or vendor fees, emergency or premium rates, and contract duration including renewal options.

CDCR must provide the required disclosure to the exclusive bargaining representative of the affected unit at the time the contract is entered into or renewed, creating a real-time transparency obligation tied to the contracting process itself.

Beginning March 1, 2028, and on or before March 1 of each year thereafter, CDCR must submit an annual report to the Legislature containing all required disclosure information for contracts in effect during the prior calendar year, submitted in compliance with Government Code Section 9795.
