Prisons: organized sports programming.

The deadline for the department to formalize its organized sports policy was extended from July 1, 2027 to January 1, 2028.

The sunset/repeal date for the entire chapter was extended from January 1, 2030 to January 1, 2036, giving the program six additional years of operation.

The bill now requires the department to 'formalize' a policy rather than 'establish' one, implying that some sports programming already exists and should be codified into official policy.

Two new factors were added that the department must consider when developing its policy: (E) geographic, climate, and infrastructure differences across facilities affecting equitable access, and (F) how to maximize access using existing recreational spaces and infrastructure.

New legislative findings were added: (d) sports programming can serve as a gateway to educational, therapeutic, vocational, restorative justice, and other rehabilitative programming; and (e) rehabilitation policies should be developed in consultation with directly impacted people including currently and formerly incarcerated individuals and their families.

Fund moneys are now available only upon appropriation by the Legislature in the annual Budget Act, rather than upon approval by the Government Operations Agency. This gives the Legislature direct control over funding through the budget process.

The role of seeking advisement from the Legislature and approving fund uses was transferred from the Government Operations Agency to the department itself, reducing an external oversight layer.

The annual reporting requirement on fund deposits was reassigned from the Treasurer to the Controller, and the first report deadline was pushed from January 1, 2028 to January 1, 2029.

New Section 3113 adds a sunset provision: the chapter remains operative until January 1, 2030, or until appropriated funds are exhausted, whichever occurs first. The chapter is then automatically repealed on that date.

The legislative counsel's digest was updated to note that the requirement for the department to establish a sports programming policy applies only 'until a specified date,' reflecting the new sunset provision.

The entire amendment to Penal Code Section 629.54 (requiring wiretap orders to specify identity of the person, nature/location of facilities, type of communication, identity of agency, and time period) was removed. The bill no longer touches on intercepted communications law.

Assembly Member Alanis was added as a coauthor of the bill.

Minor wording change in Section 3110(c): 'Sports also provide opportunities' was changed to 'Participation in sports also provides opportunities.'

The fiscal committee vote changed from 'no' to 'yes,' meaning the bill now has fiscal committee approval, which is typically required for passage in the Assembly.

Added an entirely new Chapter 10 (Sections 3110-3112) to Title 1 of Part 3 of the Penal Code, titled the Second Chance Sports Act, which requires CDCR to establish a policy on organized sports programming at state prisons by July 1, 2027.

The bill's stated purpose expanded from solely amending Section 629.54 of the Penal Code (intercepted communications) to also adding a new chapter relating to prisons. The original wiretap amendment is retained as a secondary provision with only technical, nonsubstantive changes.

CDCR must develop its sports programming policy in consultation with researchers, criminal justice reform organizations, professional and semi-professional sports teams and leagues, facility staff including correctional line staff, and organizations representing incarcerated persons and their families. The department must consider safety, resource use, eligibility requirements, and public safety impacts.

Established the Second Chance Sports Fund within the State Treasury. The fund may receive moneys from any source including private donations. The Government Operations Agency must seek advisement from the Legislature and CDCR on fund priorities and approve uses. Moneys supplement (not replace) existing funding, and no more than 5 percent may be used for administrative purposes.

The Treasurer must report to the Legislature by January 1, 2028 and annually thereafter on amounts deposited into the Second Chance Sports Fund, in compliance with Section 9795 of the Government Code.

CDCR is authorized to solicit proposals, accept unsolicited proposals, negotiate, and enter into agreements with public or private entities (including professional sports teams, UC, CSU, community colleges, and private universities) to expand access to organized sports programming at state prisons.

Assembly Member Bryan was added as a co-author alongside Assembly Member Gabriel, and the fiscal committee designation changed from 'no' to 'yes' to reflect the new appropriation-related provisions in the fund section.
