State Fire Marshal: home hardening.

Removed Government Code Section 27212, which required county recorders to maintain construction records related to home hardening and share them with the Office of the State Fire Marshal upon request. This eliminated all local government obligations from the bill.

Removed subsection (3) of Health and Safety Code Section 13134, which required the report to include an estimate of the cost to complete home hardening on homes that do not meet the standards developed under Section 13133.5.

Removed the state mandate reimbursement provision (former Section 4) that would have triggered Commission on State Mandates review and potential reimbursement to local agencies for costs mandated by the state.

Subsection (c) of Section 13134, which defined 'home hardening' as the replacement or repair of structural features affixed to property with features compliant with the California Wildland-Urban Interface Code (Title 24, Chapter 7), was deleted entirely. The bill no longer provides a statutory definition for the term.

The 2030 report requirements were changed from requiring exact counts to requiring estimates. Specifically, 'the total number of homes' became 'an estimate of the total number of homes,' and 'the number of homes that meet the standards' became 'an estimate of the number of homes that meet the standards.' This applies to both the count of compliant homes and non-compliant homes in each responsibility area and county.

The state-mandated local program designation in the legislative counsel's digest was changed from 'yes' to what appears to be a correction (shown as 'yes no'), potentially affecting whether the bill triggers state reimbursement obligations for local agencies under the California Constitution.

Section numbering was corrected. The prior version had a duplicate 'SEC. 2' label and misnumbered subsequent sections. The amendment renumbers them properly as SEC. 2 (home hardening standards), SEC. 3 (report requirement), and SEC. 4 (state mandates reimbursement).

New Health and Safety Code Section 13133.5 requires the Office of the State Fire Marshal to develop home hardening standards by January 1, 2028. These standards determine whether a home is sufficiently hardened to reduce fire risk during an ember shower or when directly exposed to flames and radiant heat.

New subsection (b) added to Government Code Section 27212 requires county recorders to share construction records related to home hardening in state or local responsibility areas with the Office of the State Fire Marshal upon request. This is explicitly identified as a state-mandated local program.

Section 13134 references to 'home hardening criteria' are replaced with references to 'the standards developed pursuant to Section 13133.5,' tying the 2030 reporting requirements to the specific standards that must be developed by 2028.

The bill's title and legislative digest are updated to reflect the addition of Section 13133.5 and the expanded county recorder duties, broadening the bill's scope from a reporting-only measure to one that also establishes new standards and data-sharing obligations.
