Human trafficking: body art practitioners.

The single training deadline of January 1, 2027 (covering massage/bodywork, hair/nail/skin care, and body art facilities) was split into two separate deadlines: January 1, 2021 for businesses in paragraphs (4) and (5), and July 1, 2027 for body art facilities in paragraph (16). This gives body art facilities a later compliance date while confirming an earlier date for the other covered businesses.

Entire Section 2 (new Government Code 8588.13) was deleted. Entire Section 3 (amendments to Health and Safety Code 119306 and new 119306.1) was deleted. New Section 1 amends Civil Code Section 52.6 to require 16 categories of businesses and establishments to post a human trafficking notice near their public entrance, including airports, rail stations, bus stations, truck stops, emergency rooms, urgent care centers, pediatric facilities, farm labor contractors, job recruitment centers, roadside rest areas, massage businesses, hotels/motels, hair/nail/skin care businesses, and body art facilities.

A local preemption savings clause provides that the new section does not supersede or preempt local ordinances, rules, or regulations that duplicate or supplement the state requirements.

Establishments described in paragraphs (4), (5), or (16) of the new Civil Code section (intercity rail stations, bus stations, and body art facilities) must provide at least 20 minutes of human trafficking awareness training to new employees and registered practitioners by January 1, 2027.

Training content must cover: definition of human trafficking (sex and labor), myths and misconceptions, physical and mental signs, identifying individuals at risk, how to report via hotlines and local law enforcement, and on-the-job reporting protocols.

Civil penalties of $1,000 for a first offense and $2,000 for each subsequent offense are imposed on non-compliant businesses. Fines collected are deposited in the Survivor Support Fund.

Enforcement is available by government entities under Section 17204 of the Business and Professions Code after providing reasonable notice and a 30-day cure period, or directly by the Attorney General.

A liability protection provision states that failure to report human trafficking by an employee or registered practitioner shall not, by itself, result in liability of the business or any other person or entity.

The bill's short title and legislative counsel digest were updated to reflect that it now also amends Section 52.6 of the Civil Code, broadening the description from solely 'body art practitioners' to include the notice-posting and employee training obligations for multiple business types.
