Children's diapers: intentionally added ingredients: disclosure.

Enforcement authority was narrowed from DTSC, the Attorney General, city attorneys, county counsel, and district attorneys to only the Department of Toxic Substances Control. Local prosecutors and the state AG can no longer bring enforcement actions under this chapter.

Penalties changed from 'administrative or civil penalty' to 'administrative penalty' only, removing the option for civil penalties.

The requirement to display the ingredient list on product details pages of third-party retail websites was changed from mandatory to permissive. Manufacturers now must have a dedicated web page on their own site, but may (not must) also display or link to that information on retailer product pages.

The web page requirement was strengthened from 'a web page on its internet website' to 'a dedicated web page on the manufacturer's internet website,' requiring a specific standalone page rather than allowing the information to be embedded in a general page.

New language clarifies that the ingredient list must cover 'the ingredients for each specific children's diaper product,' making clear the list must be product-specific rather than a generic brand-level list.

The definition of 'intentionally added ingredients' was clarified to specify that a component or breakdown product must itself be a 'chemical' that has a functional or technical effect, adding the word 'chemical' after both 'intentionally added chemical' and 'added chemical.'

Subdivision (d) no longer requires diapers that are merely 'sold' in the state to display ingredient information on their outermost package by January 1, 2029. Only diapers distributed or manufactured in the state must comply by that date. Diapers sold in the state retain the later July 1, 2029 deadline under subdivision (e).

The enforcement provision in subdivision (f)(1) appears to contain a clerical error where an extra word was inserted after 'district attorney' (reading 'district attorney Control' in the statutory text and 'district attorney department' in the summary paragraph). This does not appear to be an intentional policy change.

The amendment date was updated from June 22, 2026 to June 25, 2026, and page/line numbering was adjusted throughout due to the text changes.

The deadline for manufacturers to display intentionally added ingredient lists on their websites was changed from 'January 1, 2028, 2029' (a drafting error listing two dates) to a single clear date of January 1, 2029.

A new subdivision (e) was added requiring that by July 1, 2029, all children's diapers sold in the state must include on the outermost package the ingredient list and website address required by subdivision (d). This gives a six-month extension beyond the January 1, 2029 deadline and specifically targets diapers 'sold in the state' as opposed to the broader 'sold, distributed, or manufactured in the state' language in subdivision (d).

Subdivisions formerly labeled (e) through (j) were renumbered to (f) through (k) to accommodate the new subdivision (e). The Senate version also contains apparent drafting typos: 'distributed, distributed or manufactured' and 'in the state state' with repeated words.

The deadline for manufacturers to display intentionally added ingredient lists on their websites was pushed back one year, from January 1, 2028 to January 1, 2029.

Ingredients must now be displayed in order of chemical or raw material weight, both on the web page and on the outermost package listing. This gives consumers a clearer picture of which substances are present in the greatest quantities.

A new severability clause (subdivision j) was added stating that if any provision is held invalid, the remaining provisions continue in effect.

The fiscal committee vote changed from 'no' to 'yes,' indicating the bill now has fiscal committee support for its funding mechanism through the Toxic Substances Control Account.

A new definition for 'children's diaper' was added, covering absorbent garments or products designed for children including infants and toddlers to absorb or contain urine and fecal waste. It explicitly includes disposable briefs, protective underwear, liners, boosters, inserts, underpads, and components such as wetness indicators, absorbent linings or fillings, outer shells, adhesive tabs, dyes, and fragrance.

The web page disclosure requirement now mandates that manufacturers list the chemical or raw material name for each intentionally added ingredient, in addition to the CAS number and function or purpose. Previously only a list of ingredients, CAS numbers, and functions were required.

A new formatting requirement was added stating that all required information must be clearly grouped and displayed for each intentionally added ingredient, with the chemical name, CAS number, and function listed alongside each other rather than in separate lists.

A full enforcement section was added authorizing DTSC, the Attorney General, city attorneys, county counsel, or district attorneys to enforce the chapter. Violations carry administrative or civil penalties up to $5,000 for a first violation and $10,000 for each subsequent violation, with penalties assessable per day for continuing violations. A prevailing party is entitled to reasonable attorney's fees and costs, and remedies are cumulative with other legal rights.

Upon legislative appropriation, funds in the Toxic Substances Control Account may be used by DTSC to implement the chapter. All penalties collected under this section must be deposited into the Toxic Substances Control Account.

DTSC is authorized to adopt regulations to implement, enforce, interpret, or make specific the requirements of the chapter.

The prior version's statement that it was the intent of the Legislature to subsequently enact legislation relating to consumer protection was removed, suggesting the bill now stands as a complete enforcement mechanism rather than a precursor to future legislation.

Added a new Chapter 12.7 to the Health and Safety Code specifically regulating children's diapers, expanding the bill from a general consumer protection placeholder to a targeted product safety law.
