Probation: duration.

New subdivision (l)(2) allows the court to consider three specific factors when deciding whether to extend probation for a sex offender: progress in treatment, compliance with other terms of supervision, and whether an extension serves the interests of public safety and rehabilitation.

Subdivision (l) was restructured from a flat list of items (1), (2), (3) into a two-paragraph structure: paragraph (1) contains the existing exceptions renumbered as subparagraphs (A), (B), (C), and the new paragraph (2) holds the added consideration factors.

Removed the provision that would have eliminated the 2-year probation limit entirely for specified sex crimes (Section 290(c) offenses), serious felonies (Section 1192.7), and embezzlement/theft over $25,000, replacing it with authorization for probation up to the maximum possible sentence term.

Narrowed the remaining probation extension provision to only cover sex offenders on probation who have not completed programming, limiting the extension to one additional year rather than the maximum possible sentence term. This is a much more restrictive standard than the Assembly version.

Removed the general provision allowing courts to extend probation to the maximum possible sentence term when a probation department files a petition and the court finds the defendant has not successfully completed probation and needs additional time for programming.

A new provision was added for offenders granted probation and ordered to register as sex offenders under Section 290(c). If the probation department files a petition and the court finds the defendant has not successfully completed probation and additional time is necessary for programming, the court may extend probation by up to one additional year specifically to complete that programming.

The amendment narrows the extension mechanism for sex offenders to a maximum of one additional year tied to programming completion, as opposed to the general provision (subdivision l(5)) which allows extension up to the maximum possible term of the sentence. This creates a more specific and limited pathway for sex offender probation extensions.
