The legislative counsel's digest changed the phrase 'technical changes to existing provisions' to 'nonsubstantive changes to existing provisions,' a minor rewording with no policy impact.

Line numbers (line 1, line 2, etc.) were removed from the statutory text, and page numbers were renumbered from 97 to 96, consistent with standard enrolled bill formatting.

The bill header was updated from amendment tracking language to enrolled format showing passage by the Assembly on August 25, 2026 and the Senate on August 24, 2026, along with a Governor approval signature block.

The entire amendment to Section 4054 was deleted. That section would have exempted manufacturers/wholesalers from licensing requirements when providing dialysis drugs directly to patients, and would have exempted manufacturers, wholesalers, or distributors from licensing when furnishing enteral nutrition products directly to a patient's residence.

The mechanism changed from an exemption from licensing (Section 4051) to a direct authorization within Section 4059. Rather than being exempt from licensing requirements, these entities are now explicitly permitted to 'participate in an arrangement or agreement to deliver' the products.

The Senate version adds a requirement that delivery be conducted 'in accordance with the services and activities provided by a pharmacist, consistent with the accepted standard of care pursuant to Sections 4051 and 4052.' This imposes a professional standard-of-care obligation on the delivery arrangement.

Expanded the list of entities that may deliver enteral nutrition products directly to patients. Previously only a pharmacist or a person exempted under Section 4054 could distribute these products. Now a pharmacist, manufacturer, or wholesaler may participate in an arrangement or agreement to deliver them to a patient's residence.

Added a new definition of 'enteral nutrition supplements or replacements' as medical food used as a therapeutic regimen to prevent serious disability or death in patients with medically diagnosed conditions that preclude the full use of regular food. This replaces the prior undefined term 'enteral nutrition products.'

Changed the delivery mechanism from simply distributing products directly to patients pursuant to board regulations, to participating in an arrangement or agreement to deliver products to a patient's residence pursuant to a valid order from a prescriber acting within their scope of practice. This adds a requirement for a prescriber's order and specifies delivery to the residence.

Multiple drafting corrections: changed 'may shall not' to 'shall not,' changed 'does shall not apply' to 'shall not apply,' updated 'his or her' to 'their' throughout, and cleaned up duplicate words that appeared to be markup artifacts in the original text.
