Department of Consumer Affairs: public members of boards: conflicts of interest.

The bill no longer amends Section 4603 of the Business and Professions Code (Massage Therapy Act). That provision was a nonsubstantive change to language about the California Massage Therapy Council prioritizing public protection.

The definition of 'close family member' in Section 450.2 now includes the phrase 'includes, but is not limited to, a parent or a child,' making the list of covered relationships non-exhaustive rather than a closed list.

A new subsection (c) requires each board within the Department of Consumer Affairs to adopt regulations providing guidance on how to determine whether a relationship other than a parent-child relationship prohibits an individual from serving as a public member of a board.

New Section 1 amends Business and Professions Code Section 450.2 to define 'close family member' as: parent, stepparent, sibling, child by blood/adoption/marriage, spouse, domestic partner, cohabitant, stepchild, immediate in-law, aunt, uncle, first cousin, grandparent, or grandchild. This definition applies to the existing rule that public board members cannot be a current or past licensee of that board or a close family member of one.

The original Section 4603 amendment removes a duplicated word 'authority' (changing 'certification and disciplinary authority, authority and any other functions' to 'certification and disciplinary authority and any other functions'). This is a nonsubstantive correction.
