Sexual battery.

Eliminated the standalone offense in former subdivision (f)(1) that made it a separate crime to enter an inhabited dwelling without being a lawful occupant, resident, or guest and touch an intimate part of another person for sexual purposes. This was a new crime with its own penalty structure.

The bill's overall scope narrowed from creating a new standalone sexual battery offense tied to dwelling entry to merely enhancing penalties for existing sexual battery offenses committed in dwellings entered without consent. The conduct must already constitute sexual battery under another subdivision before the enhancement applies.

Added new subdivision (f) as a penalty enhancement: a person who violates any other subdivision of the section after entering without consent an inhabited dwelling house, trailer coach, or inhabited portion of any other building, and commits the violation while in that location, is punished by state prison for two, three, or four years plus a fine up to $10,000, or county jail up to one year plus a fine up to $5,000.

Added new subdivision (g) defining 'touches' as physical contact with the skin of another person accomplished directly or through the clothing of the person committing the offense. This is narrower than the prior definition which included contact through the clothing of the victim and did not specify skin contact.

Subdivision (f) now covers entry into an 'inhabited dwelling house or trailer coach, as defined in Section 635 of the Vehicle Code, or the inhabited portion of any other building,' rather than only an 'inhabited dwelling within the meaning of subdivision (a) of Section 460.' This significantly broadens which structures are covered by the new offense.

The entry requirement changed from entering 'without being a lawful occupant, resident, or guest' to simply entering 'without consent.' The amended language is broader because it does not require the person to lack any legal right to be there; it only requires that entry was without the occupant's consent.

The maximum fine for the misdemeanor option of the new subdivision (f) offense increased from $2,000 to $5,000. The felony penalty (state prison 2-4 years, fine up to $10,000) remains unchanged.

Gender-neutral language change: 'his or her' replaced with 'their' in the definition of 'the course of a prior treatment' in Section 728 of the Business and Professions Code.

Cross-reference correction in Section 43.93 of the Civil Code: reference to Penal Code Section 243.4 subdivisions changed from '(f) and (d), (h) and (e)' to '(h) and (e),' correcting which subdivisions define 'intimate part' and 'touching.'
