The Metro Gold Line Foothill Extension Construction Authority's project scope is reduced from extending to Montclair (San Bernardino County) to only extending to Claremont (Los Angeles County).
A new 'Claremontclair Authority' is created (new Chapter 6.5, Sections 132500-132510) to award and oversee all design and construction contracts for the light rail segment from east of the Claremont station to the Montclair Transit Center in San Bernardino County.
The new authority's board consists of 5 voting members (one each from Claremont city council, Montclair city council, LACMTA, SBCTA president, and the San Bernardino County Supervisor whose district includes Montclair) plus one nonvoting member appointed by the Governor.
LACMTA and SBCTA must enter agreements to grant or hold in trust all real property and assets necessary for the project. The authority must also enter a memorandum of understanding with LACMTA addressing LACMTA's right to review significant changes in design or construction scope.
LACMTA assumes responsibility for operating all completed phases. For the San Bernardino County portion, LACMTA's operating authority is contingent on SBCTA approving an operations and maintenance agreement, and SBCTA must reimburse LACMTA for operating costs in that county.
The new authority may accept grants, acquire property via eminent domain, incur debt secured by revenue pledges, and enter joint development agreements. However, it is prohibited from encumbering future farebox revenue or transferring obligations to LACMTA without written agreement.
The bill's fiscal committee designation changes from 'no' to 'yes,' and the state-mandated local program designation changes from 'no' to 'yes,' indicating new costs imposed on local agencies that may require state reimbursement.
The new authority must adopt an administrative code within 60 days of establishment and must make reasonable progress in design and construction as determined by the California Transportation Commission. The authority dissolves upon completion of project construction.
The definition of 'extension cities' in Section 132400 is expanded to include Montclair (previously it ended at Claremont). The project definition for the existing authority is shortened to end at Claremont instead of Montclair.
