New Section 2 amends Health and Safety Code Section 120956 to create the AIDS Drug Assistance Program Rebate Fund as a special fund in the State Treasury. New Section 1 adds legislative findings recognizing the history of the Two-Spirit term (adopted in 1990), its distinct relationship to tribal-specific identities, the role of colonization in erasing these identities, and California's unique responsibility given it has more Native American people than any other state.

New subsection (d)(2) makes organizations that serve tribal populations eligible for grants for any of the specified purposes, provided they apply in partnership with a 2TGI-serving organization. This broadens who can receive funding beyond just 2TGI-serving organizations and medical providers.

A new paragraph (8) defines '2TGI-serving organization' separately from the existing 'TGI-serving organization' in paragraph (2). The 2TGI definition requires the organization's mission to center on serving Two-Spirit, transgender, gender nonconforming, or intersex people (or any combination), with at least 65 percent of clients being 2TGI. The base TGI-serving organization definition now uses 'TGI' rather than '2TGI' for its client percentage threshold.

Therapeutic arts programs are now required to be 'evidence-based' in both the grant purposes (subsection c(2)) and the health care definition (subsection f(1)(B)). The previous version listed examples like dancing, painting, and writing without an evidence-based requirement.

In subsection (c)(1), 'cultural competency training' was replaced with 'cultural responsiveness training' and qualified with 'includes, but is not limited to,' broadening the scope of acceptable training approaches.
