Voidable transactions: remedies: choice of law.
Summary
Existing law, the Uniform Voidable Transactions Act, generally establishes the conditions under which a transfer made or obligation incurred by a debtor is voidable as to a creditor, and sets forth the remedies of a creditor with respect to a voidable transfer or obligation. Existing law specifies that a covered claim is governed by the local law of the jurisdiction in which the debtor is located when the transfer is made or the obligation is incurred. Existing law specifies, for purposes of these provisions, that a debtor's location, if the debtor is an individual, is the individual's principal residence. This bill would instead provide that a debtor's location, if the debtor is an individual, is the debtor's principal residence or domicile.

MINOR
AB 1473 makes a single substantive change to Section 3439.10 of the Civil Code: it expands the definition of an individual debtor's location from 'principal residence' to 'principal residence or domicile.' This affects which state's law governs voidable transaction claims against individual debtors, potentially broadening the set of jurisdictions whose laws could apply. The remaining differences in the diff are formatting and presentation changes from a legislative document to a web-based bill tracking format.
DEFINITION
The definition of an individual debtor's location for choice-of-law purposes was expanded from 'principal residence' to 'principal residence or domicile.' This means that if an individual's domicile differs from their principal residence (for example, a person who lives in one state but is domiciled in another), the law of either jurisdiction could now govern a voidable transaction claim against that debtor.
