Political Reform Act of 1974: prospective employment.

The bill was formally enacted as Chapter 186, with the Governor's approval date of October 1, 2025 added and the enrolled bill header (Assembly/Senate passage dates, clerk signatures) replaced by the standard chaptered law format.

Section 87202(a)(1) no longer includes the phrase 'within 30 days after assuming the office.' The filing deadline was removed from the general paragraph because it is already stated separately in paragraph (2) for elected officials (30 days) and paragraph (3) for appointed or nominated officials (30 days, or 10 days if subject to confirmation). No change in actual deadlines.

Formatting changes for the enrolled bill: line numbers removed, header updated to show 'Passed the Assembly August 25, 2025' and 'Passed the Senate July 17, 2025,' Governor's approval block added, fiscal notes section removed from the body, and page numbering adjusted.

Removed all amendments to Section 87302, which would have required public agencies' conflict of interest codes to designate positions and require designated employees to disclose arrangements for prospective employment. This eliminated the extension of the bill's requirements beyond state-level officials to local agency employees.

Removed all amendments to Section 87302.3, which would have required candidates for elective offices designated in a conflict of interest code to file statements disclosing prospective employment arrangements by the final filing date for nomination documents.

Removed all amendments to Section 87306, which would have required agencies to amend their conflict of interest codes within 90 days when circumstances changed and to submit biennial reports (by March 1 of odd-numbered years) identifying changes in designated positions, reportable income sources, and reportable prospective employers.

Section 87202 was restructured slightly: the Senate version consolidates the initial filing requirement into a single paragraph covering all officials (elected, appointed, or nominated) with a 30-day deadline, then provides specific sub-paragraphs for elected and appointed/nominated officials. The substantive deadlines remain the same as the Assembly version.

New Section 82004.2 defines 'arrangement for prospective employment' as an agreement in which a prospective employer's offer has been accepted by the prospective employee, including through verbal or written acceptance.

Public officials must now disclose arrangements for prospective employment in their initial (assuming office), annual, and leaving-office financial disclosure statements. The disclosure is required if employment with that employer had not yet begun as of the relevant date.

New Section 87207.5 specifies what must be included when reporting an arrangement for prospective employment: the date of acceptance, the business position, a general description of the prospective employer's business activity, and the name and street address of the prospective employer.

Public agencies' conflict of interest codes (Section 87302) must now include disclosure requirements for arrangements for prospective employment for designated employees. An arrangement is reportable if the position would qualify as a source of income or business position under the code's existing criteria.

Candidates for elective offices designated in a conflict of interest code (Section 87302.3) must now disclose arrangements for prospective employment in their candidacy statements filed with election officials.

A new disqualification provision requires designated employees to recuse themselves from decisions that directly relate to their prospective employer pursuant to Section 87407, in addition to the existing financial interest disqualification standard.

New Section 87306(b) requires state agencies to submit biennial reports by March 1 of each odd-numbered year identifying changes to their conflict of interest codes, including new designated positions, changes in reportable sources of income, and reportable prospective employers.

The bill's voting threshold changed from a simple majority to a two-thirds vote of each house, because the amended version now substantively amends the Political Reform Act of 1974, which is an initiative measure requiring supermajority approval for amendments.

Fiscal committee review changed from 'no' to 'yes,' and state-mandated local program designation changed from 'no' to 'yes,' reflecting the new compliance costs imposed on local agencies. However, no state reimbursement is required because the costs arise from creating a new crime or infraction.

Removed a standalone section (formerly Section 1) that declared it was the intent of the Legislature to enact legislation relating to the Fair Political Practices Commission. This removed a specific legislative declaration tying the bill to FPPC authority.

Added Section 87204 to the list of sections being amended in the bill's operative description, making explicit what was already addressed in the body text.
