Section 4921 is deleted entirely. It had required boards to notify members of litigation involvement in the annual budget report and allowed members to request court name and case number. This disclosure is already covered by existing Section 5300(13), making the new section redundant.

Section 4941(a)(2) adds an exemption for recordings used solely for the purpose of creating meeting minutes. Such recordings may be deleted 12 months after the draft minutes are completed, relieving associations of permanent retention obligations for working recordings.

Section 5235 is deleted entirely. It had provided a civil cause of action for members whose right to inspect association records was unreasonably withheld, with attorney's fees, court costs, and a civil penalty of up to $500 per violation, plus small claims court jurisdiction.

Section 4950(d) requires that when the board votes on an amendment, adoption, or repeal of an operating rule during a meeting, the minutes must include how each director voted on that measure.

Section 4910(c)(2) adds an explicit safe harbor stating that informational or ministerial communications sent solely to schedule, notice, organize, or facilitate a board meeting are not prohibited, provided they do not involve deliberation, debate, advocacy, or discussion of board business and do not result in board action.

New requirement that the annual budget report (Civil Code Section 5300) must include a statement listing any active litigation in which the association is named as a party, including the name of the court and case number. 'Active litigation' is defined as any civil action commenced and pending in state or federal court that has not been finally resolved, closed, or dismissed.

New Section 4921 requires the board to provide notice of litigation involvement as part of the annual budget report distributed to members, and allows any member receiving that notice to request the name of the court and case number.

Executive session minutes for ongoing litigation now must include the case name, case number, and name of the court (previously only required the case name).

The recording notice requirement in Section 4941(b) is clarified to apply only 'for meetings that are being recorded,' rather than applying to every open session unconditionally.

Section 4950(a) now requires that if a member requests a physical copy of the minutes, the association shall make the minutes available pursuant to Section 5205. Also adds that an association is not obligated to have or continue to maintain an internet website.

Exclusions from the definition of 'litigation' for budget report disclosure: small claims actions, superior court actions seeking judicial foreclosure, actions to obtain a monetary judgment regarding a member's debt, actions enforcing governing documents against a member, and any action where disclosure would pose a threat to the health and safety of any individual.

The entire amendment to Health and Safety Code Section 50408 was deleted. This had required the Department of Housing and Community Development to include an evaluation of the HHAP program (as administered by the Business, Consumer Services, and Housing Agency and the Interagency Council on Homelessness) in its annual report to the Governor and Legislature.

The bill's stated purpose was narrowed from covering both housing reporting and common interest developments to covering only common interest developments. The legislative counsel's digest removed all references to the HHAP program and housing department reporting.

Assembly Member DeMaio was added as a coauthor of the bill.

Section 5235 penalty language changed from 'for the denial of each separate written request' to 'for each violation,' broadening the scope of conduct subject to the $500 civil penalty beyond just denials of written record requests.

Section 4950 changed 'members may be directed to the association's website' to 'members shall be directed to the association's website,' making it mandatory rather than permissive for associations to direct members to their website for minutes.

All amendments to Government Code Section 65589.5 (the Housing Accountability Act) were removed from the bill. The prior version described these as nonsubstantive changes to housing development project approval standards.
