Developmental services: initial intake.

New Section 827.16 authorizes county welfare or probation departments to disseminate information from juvenile case files to regional centers as necessary for completing the required case conference and assessment, including determining whether expedited assessment circumstances are present.

The bill replaces all references to 'foster child' with the broader term 'child welfare involved child or youth,' which includes children removed from home, children subject to Section 300 or 602 juvenile court petitions (whether or not removed), tribal dependent children, children in voluntary placement agreements, and nonminor dependents. This significantly expands the population covered by the case conference requirement.

The foster-child-specific expedited assessment deadline is removed from Section 4643. Previously, if a client was a foster child, assessment had to be completed within 60 days of initial intake. This specific provision no longer exists in the amended version.

Section 4642(C) previously prohibited a decision not to provide assessment from being based solely on either lack of documentation OR age at diagnosis. The amended version removes the documentation-based prohibition, leaving only the age-at-diagnosis prohibition. A regional center can now decline assessment based solely on lack of documentation.

Section 4643(a)(2) previously required assessment to be conducted within applicable timelines 'irrespective of whether the person possesses that documentation' and required the regional center to assist in collecting and procuring documentation. The amended version removes these protections and instead states assessment is 'conditional upon receipt of the release of information and consents for assessment.'

The case conference description in Section 4642(D)(ii) now explicitly includes determining 'whether any of the circumstances necessitating an expedited assessment under paragraph (1) of subdivision (a) of Section 4643 are present,' adding a new purpose to the conference.

The separate foster-child intake determination provision (subparagraph B of Section 4642(a)(3)) is removed. Previously, for foster children specifically, the regional center had to either determine eligibility or refer for assessment within 15 days. Now all individuals are subject to the same single standard.

The definition of 'request for assistance' is narrowed. It previously included any initial contact or inquiry about the nature of services available OR possible eligibility. The amended version limits it to inquiries specifically about the individual's possible eligibility to receive services based on a potential developmental concern or disability.

The data reporting requirements in Section 4643.1 are simplified. The previous version required separate tracking of foster children across all metrics (number of intakes, percentages, averages, denials, appeals). The amended version removes the separate foster-child tracking and requires only general statewide intake data by regional center.

The bill text was reformatted from a traditional legislative document with line numbers and page headers into a web-based presentation format. No changes to the actual statutory language or policy content were made.

New Section 4435.1 added requiring statewide uniformity in regional center practices: standardized intake process by January 1, 2025; standardized individual program plan template by January 1, 2025; standardized respite assessment processes by January 1, 2026; standardized vendorization procedures by January 1, 2026; and guidance to end 'courtesy vendorization' by March 1, 2028.

New mandatory case conference requirement for child welfare involved children or youth: regional centers must facilitate a conference within 15 working days of the initial request for assistance, including the county child welfare agency, probation department, or tribal consortium. The conference must clarify consents, legal determinations, documentation needs, and health/safety concerns. Joint guidance from DDS and SSDS required by March 31, 2027.

New requirement that regional centers work with child welfare agencies to obtain consents, identify document sources, coordinate access to documentation, or directly procure records for child welfare involved children or youth when documentation is lacking.

Section 4643(a)(2) changed from requiring regional centers to assist in collecting documentation with assessment proceeding regardless of whether the person possesses it, to making assessment 'conditional upon receipt of the release of information and consents for assessment.' This is a significant practical change that could delay assessments if consents are not obtained.

The term 'foster child' is renamed to 'child welfare involved child or youth' throughout the bill. The underlying categories (removed children, juvenile court petition subjects, tribal dependents, voluntary placement agreement children, nonminor dependents) remain unchanged.

The Assembly version required an annual report to the Legislature with a sunset date of January 1, 2030. The Senate version replaces this with a permanent public data posting requirement on the department website commencing January 31, 2028, plus quarterly reporting to LOIS and annual statewide intake data disaggregated by demographic groups including age, geography, and race.

New requirement that by January 30, 2027, the department consult with SSDS, tribes, individuals with lived experience, and child welfare stakeholders to ensure consideration of child welfare involved children or youth in developing standardized intake processes, including circumstances for expedited intake.

A new prohibition was added in Section 4642(a)(2)(C) barring a regional center from denying assessment based solely on the age at which the person received a diagnosis of a qualifying condition, provided the condition originated before the person turned 18. This closes a gap where adults diagnosed later in life could be denied services even if their disability began in childhood.

The annual reporting requirement in Section 4643.1 now requires data to be posted by individual regional center and on a statewide-aggregate basis, rather than only statewide totals. This adds transparency about which regional centers are meeting timelines.

Two new data points were added to the annual report: (9) average days between a request for assistance and initial intake, and (10) average days between initial intake and assessment, each tracked separately for general applicants and foster children. These metrics give the Legislature direct visibility into processing speed.

A new reporting category (11)(D) was added to track the number of instances where individuals or foster children challenged an intake denial or eligibility denial through appeals, mediation conferences, or due process hearings. This provides data on how often people are forced to contest denials.

The demographic reporting category in Section 4643.1(a)(2)(I) was changed from reporting only age, race/ethnicity, and preferred language of denied individuals to also include the number of instances for each category, giving a sense of volume alongside demographics.
