AB 1090 California Assembly · 2025-2026 Regular Session

Alcoholism or drug abuse treatment facilities: County of Orange pilot program.

Summary
Existing law provides that the State Department of Health Care Services has the sole authority in state government to license adult alcoholism or drug abuse recovery or treatment facilities, as defined. Existing law authorizes the department to conduct announced or unannounced site visits to licensed facilities to review compliance with all applicable statutes and regulations. This bill would require the State Department of Health Care Services to establish a pilot program to locate an investigator within a participating county to investigate complaints against licensed adult alcoholism or drug abuse recovery or treatment facilities within the county. The participating county would be the County of Orange if the Orange County Board of Supervisors elects to participate in the pilot program. The bill would require the department to implement the pilot program by executing a contract with the County of Orange providing that the department will assign an investigator and the county will reimburse the department for the costs associated with the pilot program, including, but not limited to, the administrative costs and the investigator's compensation and benefits. The bill would require the pilot program to be completed no later than December 31, 2029, and would require the county to submit a report of the results of the pilot program, as specified, to the Legislature no later than December 31, 2030. The provisions of this bill would be repealed on December 31, 2034.

MODERATE
AB 1090 was substantially expanded from a minor technical fix to a behavioral health screening notice provision into a bill that also creates a pilot program requiring the State Department of Health Care Services to station a Substance Use Disorder Compliance Division investigator in Orange County to investigate licensed adult alcoholism or drug abuse treatment facilities. The county must elect to participate, reimburse the state for all program costs including the investigator's compensation, and provide office space. The pilot runs through 2029 with a legislative report due by end of 2030, and the entire provision sunsets in 2034.
Scope change
The bill's scope expanded significantly from a single technical amendment to a behavioral health screening notice requirement into a dual-purpose bill that also establishes a time-limited pilot program for localizing substance use disorder compliance investigations in Orange County, with a sunset date of 2034.
SCOPE

New Section 11834.19 adds a pilot program for the State Department of Health Care Services to locate a Substance Use Disorder Compliance Division investigator in Orange County to investigate complaints against licensed adult alcoholism or drug abuse recovery or treatment facilities.

ELIGIBILITY

Orange County must adopt an ordinance or resolution electing to participate in the pilot program; it is not mandatory for the county.

FISCAL

Orange County must reimburse the department for all pilot program costs, including administrative costs and the investigator's compensation and benefits. The county must also provide office space and amenities to the investigator.

The fiscal committee vote changed from 'no' to 'yes,' reflecting the new fiscal impact created by the county reimbursement structure for the pilot program.

TIMELINE

The pilot program must be completed no later than December 31, 2029. A report of results (including an effectiveness evaluation and recommendations) is due to the Legislature by December 31, 2030. The section is repealed on December 31, 2034.

TECHNICAL

The original technical fix to Section 1368.017 (removing a redundant 'including' in the definition of behavioral health and wellness screening) remains but is now secondary to the new pilot program provisions.
