Local Government Omnibus Act of 2023.

(1) Existing law prohibits a person from being eligible for election or appointment to the office of the county treasurer, county tax collector, or county treasurer-tax collector of any county unless that person meets at least one of several criteria, including that the person possess a valid certificate issued by the Treasury Management Association showing the person to be designated as a Certified Cash Manager, with a minimum of 16 college semester units, or their equivalent, in accounting, auditing, or finance. This bill would remove, commencing January 1, 2024, that criterion as an option for eligibility for the above-described offices. (2) Existing law authorizes a county recorder to use a printed, stamped, or photographically reproduced facsimile signature in certifying to a record in the recorder's office provided that the certification has the seal of the recorder's office affixed thereto. This bill would authorize a county recorder to also use electronic or otherwise digitally created signature in certifying a record. Existing law requires a county recorder to keep an official seal of the recorder's office that is required to be legible when embossed, stamped, impressed, or affixed to a certification. This bill would authorize the seal to be applied manually, mechanically, electronically, or by other digital means. The bill would make other nonsubstantive changes. (3) Existing law regulates the investment of public funds by local agencies, as defined. Existing law authorizes the legislative body of a local agency, as specified, that has money in a sinking fund or in its treasury not required for immediate needs to invest the money as it deems wise or expedient in certain securities and financial instruments, subject to various requirements. Existing law authorizes local agencies, as specified, to invest in a mortgage passthrough security, collateralized mortgage obligation, mortgage-backed or other pay-through bond, equipment lease-backed certificate, consumer receivable passthrough certificate, or consumer receivable-backed bond, subject to specified limitations. This bill would exempt from those limitations imposed on investment in mortgage passthrough security, collateralized mortgage obligation, mortgage-backed or other pay-through bond, equipment lease-backed certificate, consumer receivable passthrough certificate, or consumer receivable-backed bond forms of investment those securities issued or guaranteed by specified federal agencies or issuers. (4) Existing law generally requires the governing body of a sanitation district to be a board of directors with at least 3 members. Existing law imposes specific requirements on the governing bodies of the Sacramento Area Sewer District and the Sacramento Regional County Sanitation District. This bill would repeal the requirements for the governing body of the Sacramento Area Sewer District and would rename the Sacramento Regional County Sanitation District the Sacramento Area Sewer District. The bill would make these changes contingent upon the Sacramento Local Agency Formation Commission issuing a certificate of completion for the dissolution of the Sacramento Area Sewer District and annexation of the former territory of the Sacramento Area Sewer District into the Sacramento Regional County Sanitation District on or before January 1, 2024.
