Community care facilities: criminal background checks.

Existing law requires the State Department of Social Services to license and regulate community care facilities, residential care facilities for persons with chronic, life-threatening illness, residential care facilities for the elderly, childcare centers, and home care services. Existing law requires the department to obtain a criminal record for all applicants for licenses for these facilities and services and specified other employees and officers of these facilities. Existing law permits an individual to transfer a current criminal record clearance from one facility to another following a written request to the department, as specified. Existing law requires an individual submitting a request under these provisions to verify their identity by including a copy of the individual's driver's license or identification card issued by the Department of Motor Vehicles, or a valid photo identification issued by another state or the United States government if the person is not a California resident. This bill would instead require a request for a transfer of a criminal record clearance to be submitted on a form provided by the department or via the department's secure online portal. The bill would permit the licensee to verify the individual's identity and removes the requirement for an individual to submit a copy of their driver's license or other valid government-issued identification along with a request for transfer of a criminal record clearance. This bill would incorporate additional changes to Section 1522 of the Health and Safety Code proposed by AB 1720 to be operative only if this bill and AB 1720 are enacted and this bill is enacted last. This bill would incorporate additional changes to Section 1568.09 of the Health and Safety Code proposed by AB 1720 to be operative only if this bill and AB 1720 are enacted and this bill is enacted last.
