Alcoholic beverages: delivery.
Summary
Existing law, the Alcoholic Beverage Control Act, which is administered by the Department of Alcoholic Beverage Control, regulates the application, issuance, and suspension of alcoholic beverage licenses. The act prohibits an off-sale licensee from delivering alcoholic beverages from an order received over the telephone or other electronic means without requiring proof of age and identity when the beverages are delivered. Unless otherwise specified, a violation of the act is a misdemeanor. This bill would impose additional conditions to be met for an alcoholic beverage to be delivered to a consumer pursuant to an order received by telephone or other electronic means, including, among other things, that the person delivering the alcoholic beverage has completed appropriate training, as specified, and makes a determination that the person taking delivery is not obviously intoxicated. By expanding the scope of an existing crime, the bill would impose a state-mandated local program. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that no reimbursement is required by this act for a specified reason.
