Alternative workweek schedule: election results: reporting.

Summary
Under existing law, an alternative workweek schedule proposed by an employer may be adopted through a 23 majority vote of the employer's employees in a secret ballot election. Existing law requires the results of that election to be reported by an employer to the Division of Labor Standards Enforcement within 30 days after the results are final. Existing law makes a violation of these provisions punishable as a misdemeanor. This bill would instead require the report by the employer to be provided within 15 days. By decreasing the days to report the election results, this bill would expand an existing crime and would, therefore, result in a state-mandated local program. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that no reimbursement is required by this act for a specified reason.
