Song-Beverly Consumer Warranty Act: alarm companies.

Summary
Existing law, the Song-Beverly Consumer Warranty Act (Warranty Act) , requires a service contract, as defined, to include certain items of information and, unless the service contract expressly provides otherwise, obligates a service contract to obligate the service contractor to provide to the buyer of the product all of the services and functional parts that may be necessary to maintain proper operation of the entire product under normal operation and service for the duration of the service contract and without additional charge. The Warranty Act also prohibits a service contract covering a motor vehicle, home appliance, or home electronic product, defined to include an electronic alarm system normally used or sold for personal, family, or household purposes, purchased for use in this state from being offered for sale or sold unless certain criteria are met, including that the contract complies with the provisions described above and discloses, as prescribed, the buyer's specified cancellation and refund rights provided by the Warranty Act. Existing law, the Alarm Company Act, provides for the licensure, registration, and regulation of alarm company operators and alarm agents by the Bureau of Security and Investigative Services within the Department of Consumer Affairs. This bill would exempt from the provisions of the Warranty Act described above an alarm company subject to the Alarm Company Act.
