Criminal offender record information: referral of persons on supervised release.

Existing law prohibits an employee of a criminal justice agency from furnishing information obtained from specified records, including information accessed via the California Law Enforcement Telecommunications System (CLETS) to any person not authorized to obtain that information. This bill would authorize specified local law enforcement agencies to furnish limited information about persons on supervised release within their jurisdiction to a county, city, city and county, or nonprofit organization that provides transitional services to persons on supervised release. The bill would require a person on supervised release to be notified that they may consent to the release of their information for this purpose and would allow those persons to opt in to having their information released. The bill would require the law enforcement agency, prior to releasing any information, to contact the supervising agency, as specified, to verify whether the person has opted-in, and, in the case of persons on probation, to subsequently notify the probation department of any referral given to a service provider. By placing additional requirements on postrelease supervision agencies, this bill would impose a state-mandated local program. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to the statutory provisions noted above.
