Conspiracy: shoplifting.
Summary
Existing law makes it a crime, punishable as a misdemeanor or a felony, for 2 or more persons to conspire to commit any crime. This bill would specify that the crime of conspiracy occurs when 2 or more persons conspire to commit shoplifting, and that the punishment for that conspiracy offense would be a felony, as specified. The bill would provide that conspiracy to commit shoplifting would be known as "organized retail crime." By changing the punishment for an existing crime, this bill would impose a state-mandated local program. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that no reimbursement is required by this act for a specified reason.
