AB 2907 California Assembly · 2017-2018 Regular Session

Labor Code Private Attorneys General Act of 2004.

Summary
The Labor Code Private Attorneys General Act of 2004 authorizes an aggrieved employee on behalf of themselves and other current or former employees to bring a civil action to recover specified civil penalties, that would otherwise be assessed and collected by the Labor and Workforce Development Agency, for the violation of certain provisions affecting employees. The act requires the employee to follow prescribed procedures before bringing an action and establishes specific procedures for categories of violations. Existing law requires an employer, at the time of payment of wages, to provide his or her employees with itemized wage statements that meet specified requirements. Existing law authorizes an employer to cure a violation of certain requirements regarding itemized wage statements brought under these provisions, within a 33-day period after being notified of the violation, by providing a fully compliant itemized wage statement to each aggrieved employee, as specified. This bill would authorize an employer to cure any violation brought under the act regarding itemized wage statements by using the cure procedure described above. The bill also would make related conforming changes.
